ORDINANCE NO. 559
AN ORDINANCE DEFINING THE OFFENSE OF RECKLESS DRIVING AT•D CARELESS
DRIVING AND FIXING PENALTIES THEREFOR AND REPEALING ALL ACTS AND
PARTS OF ACTS CONFLICTING HEREWITH.
BE IT HEDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL:
Sec. 1. Driving an automobile or other vehicle in a reckless
manner is (1) the violation of two or more of the traffic control
regulations of the City of Kalispell as set forth ir_ Sec. 264 to
30 , both inclusive, of the Revised Ordinances of 1947 of Kalispell
and any amend ents thereof or additions thereto, or (2) driving
such vehicle in such manner as shall have caused an accident, or
(3) driving such vehicle in a manner which indicates a wilful or
reckless disregard for one's own safety or the safety of others.
Sec. 2. Every person driving an automohle or vehicle in or
upon any street, avenue, alley or other public way within the
corporate limits of the City of Kalispell in a reckless manner
as defined in Section 1 of this ordinance shall be deemed guilty
of reckless driving, and on conviction thereof shall be punished
by a fine of not less than $25.00 or more than $300.00 or by
imprisonment for not less than 10 or mo-e than 90 days, or by both
such fine and imprisonment.
Sec. 3 Every person driving an automobile or other vehicle
an or upon any street, avenue, alley or other public way within
the corporate limits of the City of Kalispell in other than a
careful, eautious and prudent manner, or in violation of any
traffic rule or Ordinance of the City of Kalispell ns the same now
is or may be hereafter provided, but whose conduct or manner of driving
shall not constitute reckless driving or driving in a reckless
manner as defined in Section 1 of this Ordinance shall be deemed
guilty of carele s driving, and on conviction thereof, shall be
punished by a fine not less than $5.00 or more than $50.00 or by
imprisonment for not less than five nor more than 15 days or by both
such fine and imprisonment.
Section 4. All ordinances and parts of r�dinances in conflict
herewith are hereby repealed.
