ORDINANCE NO. 554
AN ORDINANCE AMENDING SUB -SECTION VII.D OF SECTION 678 OF THE
REVISEDORDINANCES OF THE CI-TY OF KALISPELL OF 1947, RELATING
TO BUILDING RESTRICTIONS IN BUSINESS-RESIDE;?CE DISTRICT NO.5-A
AS DEFINED IN THE ZONING ORDINANCE OF THE CITY OF KALISPELL.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL:
That sub -section VII.D of Section 678 of tle Revised
Ordinances of the City of Kalispell of 1947, enacted as a
portion of Ordinance No. 500 of the City of Kalispell, known
as the Zonir_g Ordin-nce, be and the same hereby is amended to '
read as follows:
Sec. 1 Subsection VII.D No. 5-A Business -Residence District.
In the Business-Fesidence Listrict No. 5-A no building struc-
ture shall be erected or materially altereA -or shall any build-
ing or premises be used except for one or more of the following
us s;
1. Any use permitted in the Main 1usiness District except that
no liquor, beer or intoxicating beverage of any kind shall be
sold or served in any business place nor shall any dance hall
be allowed.
2 till buildings shall be so placed that there shall be a,
front yard having a depth of not less than twenty-fi^e (25)
feet on an avenue side and side yard of not less than ten
(10) feet on the street side of cornerlots, and such yards
front and side, shall be entirely unoccupied by any structure
or building; provided, however, that on North Liam Street,
from the railorad tracks to Oregon Street, construction may
extend to all property lines'except those .djacent to Idaho
Street; and provided further that construction in Zone 5-A
on lots adjacent to, and extending one Hundred (100) feet
back from Idaho Street may be within five (5) feet of the '
property line on the avenue side or end of all such lots.
Sec.2. All Ordinances and parts of Ordinances in conflict
herewith are hereby repealed.
S,c. 3. This Ordinance shall be and re,n.in in full force
and effect thirty days after its passage a,d approval.
Passed by the City Council and approved by the Mayor on
this 3rd day of MU , 1948.
