ORDINANCE NO. 540
AN ORDINANCE RESTABLISHING AND DECLARING THE NECESSITY FOR CHARGES
AND RENTALS FOR USE OF THE PUBLIC SEWERS OF KALISPELL AND FIXING
AND DETERMING THE AMOUNT THEREOF AND PROVIDING FOR COLLECTION OF
THE SAME.
WHEREAS, the City of Kalispell has established, built and con-
structed and now operates and maintains for public use a sewerage
and sewage disposal facilities including a plant for treatment and
disposal of sewage therefrom and it has been determined and this
' ordinance does determine that sewage treatment the said disposal
plant prevents pollution of water supply and It is necessary and
beneficial for said City and public that under the provisions of
Chapter 149 of the Laws of the 28th Legislative Assembly as amended
by Chapter 100 by the Laws of the 30th. Legislative Assembly just
and equitable rates, charges or rentals for the services and benefits
directly or indirectly furnished by said sewage disposal plant be
made and charged as a surcharge on the water bills of water con-
sumers of the City of Kalispell, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALICSPELL:
Section 1. That there be and there hereby is charged against
each and every person, firm and corporation using or making use of
the sewage disposal system plant and facilities of the City of
Kalispell charges or rentals for the service and benefits directly
or indirectly furnished thereby, which charges or rentals are hereby
fixed on the basis of water consumption by the several persons, firms t,n
and corporations making use of such sewage disposal facilities and
which rates charges, or rentals shall be and hereby are established
as a surcharge on the water bills of water consumers of the City
of Kalispell.
Section 2. Such rents, charges or rentals fixed and established
as provided in Section 1. of this ordinance shall be as follows:
' 1. For each and every water measuring meter in any
residence, duelling house, or church, in the City of Kalispell or
which may hereafter be constructed, established, or installed within
the limits of the City of Kalispell, the sum of 50c per month.
2. For each and every water meter installed and used in
any apartment house or dwelling, restaurant, store or merchandising
establishment, office building, or any and every other type of struct-
ure wherein any water meter is installed or may hereafter be installed
and used within the City of Kalispell, expept as provided in the next
paragraph hereof, the sum of $1.00 per month per meter.
3. For each and every service station wherein any water
meter is now or may hereafter be installed or used within the limits
of the City of Kalispell the sum of $1.50 per meter per month.
4. For each and every hospital hotel, school, garage, or
other public building wherein any water meter is now or may hereafter
be installed or used within the limits of the City of Kalispell, the
sum of $2.00 per month.
Secio tn It shall be the duty of the City Water Department of
the City Kalispell and of the officials and employees thereof to
charge for and collect the sewer service charges and rentals herein
provided for as a surcharge on the water bills of water consumers of
the City of Kalispell and to do all things necessary to insure the
collection of such sewer service charges and rentals with and as a
part of the water consumption charges collected for such water de-
partment and through its facilities.
