ORDINANCE No. 504
AN ORDINANCE RELATING TO THE LICENSING OF SLOT MACHINES, PROA
VIDING FOR A CITY LICENSE AND FOR THE PAYMENT OF LICENSE FEES
FOR THE USE, OPERATION AND T!'AINTENANCE OF SLOT MACHINES BY
RELIGIOUS, FRATERNAL, CHARITABLE OR NO10PROFIT ORGANIZATIONS;
PROVIDING PENALTIES FOR THE VIOLATION ^F THIS ORDINANCE ND
PRODEDURE FOR THE ENFORCEMENT THEREOF, AND FOR PROHIBITING
MINORS FROM PLAYING SLOT 1ACP_INES, AND DECLARING THIS TO BE
AN EMERGENCY ORDINANCE.
' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA:
Section I. No slot machine shall be used, operated, kept or
maintained for use or operation within the City of Kalispell,
"Rontana, by any person or persons whomsoever, save and except
as in this Ordinance provided. In addition to its ordinary
meaning the word "persons" as used herein includes both natural
and artificial persons and embraces all partnerships, corp-
orations, associations, societies and all other persons of
every sort and kind.
Section II. Religious, fraternal, charitable or non-profit
organizations, before using, operating keeping and maintaining
for use any slot machine, must first procure the license from
the City of Kalispell by paying the fees therefore to the City
Treasurer of the City of Kalispell, all as provided for in this
Ordinance; provided however, that such religious, fraternal,
charitable or non-profit organizations are the sole and complete
owners of said slot machine or machines and the entire profit,
if there is any therefrom, shall go to said organizations.
SectionsIII. It is further provided that no license for any slot
machine shall be issued to any of the above named organizations
' until the applicant therefor shall have been granted a license
from the State Board of Equalization of the State of Montana for
such slot machine or machines for which license application is
made to the City Treasurer.
Section IV. A license fee of (t25.00) twenty-five Dollars per
annum per machine shall be paid to the City Treasurer of the City
of Kalispell for the license herein provided for. For each
separate slot in any slot machine an additional license fee,
equivalent to the fee hereinbefore provided for, shall be paid.
The using, operating, keeping or maintaining for use or operation,
of any slot machine or machines within the City of Kalispell
without first obtaining a license therefor from the City Treas-
urer is hereby declared to be a nuisance, and upon conviction
thereof the person or persons guilty of keeping or maintaining
such nuisance shall be punished as hereinafter provided.
Section V. A slot machine is herein defined as a machine operated
by inserting a coin, token,.or trade check therein by the player
and from the play of which he obtains, or may obtain, money,
checks, chips or tokens redeembble in money.
Section VI. All licenses shall be issued and the license fees
for the same shall be paid not later than January 15th of the
year for which said license is obtained. License for the year
' 1945 shall, however, be issued on or before July 15, 1945, and
shall be issued for the remainder of the year 1945 at one-half
(1/2) of the license fee provided for in this Ordinance.
Section VII. No Licensee shall permit any person under the age
of majority to play any slot machine used, operated, or main-
tained by said licensee, or to loiter about the premises where
any such slot machine is kept or operated. Any violations of
the provisions of this Section shall constitute a nuisance and
shall be punishable as provided in this Ordinance.

Section VIII. Any person, partnership, cooperative association,
club, society, fraternal order or any other individual or
organization which has not been issued a license under this
Ordinance and which maintains for use or permits the use or
operation of any slot machine as herein defined on any place
or premises owned, occupied or controlled by him or it, or who
violates any of the provisions of this Ordinance, shall be guilty
of maintaining a nuisance and upon conviction thereof shall be
punished by a fine of not less than Fifty Dollars ($50.00) nor
more than Three. Hundred Dollars ($300.00), or by imprisonment
for a term of not less than ten (10) nor more than ninety (90)
days, or by -both such fine and imprisonment. Any violation of
the provisions of this Ordinance by any licensee shall subject
such licenses upon conviction to a revocation of his or its
license and such licensee shall be ineligible to apply for or
receive a slot machine license for a period of one (1) year after
such revocation.
Section IX. An emergency is hereby declared to exist, and this
Ordinance is hereby declared to be an Emergency Ordinance,
immediately necessary for the peace, and health and safety of
the City of Kalispell, and this Ordinance shall be and remain
in full force and effect from and after its passage and approval.
Passed by the City Council and approved by the Mayor of the
City of Kalispell this 2nd day of July, 1945.
