ORDINANCE NO. 502
AN ORDINANCE REG..LATING AND PROVIDING THE HOURS PdHEN
MINORS SHALL BE PROHIBITED UPON THE STREETS AND ALLEYS OF
THE CITY OF KALISPELL AND PROVIDING EXCEPTIONS THKFETO;
PROVIDING A PENALTY FOR PARENTS WHOSE CHILD OR CHILDREN
VIOLATE THE PROVISIONS OF THIS ORDI�:ANCE; PROVIDING PENAL-
TIES FOR VIOLATICiN OF THIS ORDINANCE AND ;,EPEALING SECTIONS
680 and 6S1 OF THE REVISED ORDIIv'ANC:S OF THE CITY OF KALISe
PELL AND ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT
HEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISrELL,
MONTANA:
SECTION 1. It shall be unlawful for minors under the age of
14 years to be in or uron or to loiter upon or frequent the
streets and alleys within the city limits of the City of
Kalispell between the hours of 10:00 o'clock P.M. and 6;00
o'clock A.L. following.
SECTION 2. It shall be unlawful for minors between the ages
of 14 years and 18 years to be in or upon or to loiter upon
or frequent the streets and alleys within the city limits of
the City of Kalispell between the hours of 12:00 P.M. and
6:00 A. M. following.
SECTION 3. The provisions of this ordinance shall not apply
to any minor going to or returning from his or her place of
employment nor to any minor accompanied by his or her parent,
guardian or other adult person having the care or custody of
such minor or where such minor is engaged upon an errand or
business directed by his or her parent, guardian or adult
person having his or her care or custody, provided however,
that any such minor embraced with the provisions of this sec-
tion shall not unnecessarily linger or loiter at any time while
engaged or occupied as in this section above provided.
SECTION 4. The parent or parents or legal guardian of any
minor who shall violate any of the provisions of this ordin-
ance shall be deemed guilty of a misdemeanor and.upon con-
viction thereof shall be punished by a fine of not to exceed
the sum of One Hundred Dollars ($100.00) or by imprisonment
not to exceed thirty (30) days or by both such fine and
imprisonment.
SECTION 5. Any minor violating any of the provisions of
this ordinance shall be taken into custody, turned over to
the Probation Officer of the Juvenile Court and dealt with
according to the provions of state law governing offenses
committed by juvenile delinquents.
SECTION 6. Sections 680 and 681 of the Revised Ordinances
of 1928 of the City of Kalispell and all Ordinances and parts
of Ordinances in conflict herewith are hereby repealed.
