COMMITTEE MINUTES
4:00 P.M.
Attendance: Chairman Gunnerson, Councilman Nystul
• Others Present: Mayor Kennedy, City Attorney Neier, DPW Hammer, Susan Moyer and
Ross Plambeck, Community Development, Construction Inspector Van Dyke, Surveyor
Zavodny, Asst. Fire Chief Main, Allen Bardwell, Traffic Sign Technician, Dennis
Carver, Carver Engineering, Don Whaley, LHC, Inc., Say Billmayer and Robert
Stauffer, Billmayer Engineering.
C. Gunnerson opened the meeting and with introduction of Mr. Whaley began with the
following agenda item.
PETROLANE Mr. Whaley stated a brief history of the Petrolane site in regard to
the Conditional Use Permit granted by the Board of Adjustment. One of the conditions
placed upon the Grant of Conditional Use Permit No. 152, dated August 31, 1988
is as follows: 6) "That a system be devised and installed to ensure that the
sprinkling system can be activated on site rather than waiting for the Fire Department
to activate it". LHC believes this condition to exceed what is necessary for fire
protection but has agreed to the condition. Mr. Whaley is requesting the City to
provide materials, labor, and equipment to tap the main and extend an 8" water line
to the property, at which point LHC will pay all other expenses to comply with this
condition.
City Attorney Neier stated the Board of Adjustment did not commit the City to incur
the cost of the tap and extension.

There being no',other agenda items pertaining to Petrolane, Mr. Whaley then excused
himself from the meeting.
STORM DRAINAGE PLAN - SW KALISPELL Mr. Carver, Design Engineer, stated a brief
explanation for the current design which addresses storm drainage in the Southwest
Kalispell project area. The Request for Proposals requested a storm drainage analysis.
The Design Engineering Contract specified Carver Engineering to address and evaluate
both the options of installing ditches and culverts and installing curb and gutter.
The right of ways in the streets are too narrow to provide adequate room for ditches.
The detailed cost for ditches and culverts, $72,000, compared to the cost of curb
and gutters, $74,000, moved the design stage to utilize the installation of curb and
gutter.
Susan Moyer stated under the Block Grant Regulations, the City cannot create an SID
to any low to moderate income people in the area. If there were an SID created,
Community Development would have to pay the amount using Block Grant funds, which
have already been allocated for hookup fees, 45% of construction of the sewer system,
and replacing existing water lines. Street reconstruction was not included.
C. Gunnerson stated if the City is staying within the budgeted amount of allocated
money there is not any question to install curb and gutter. If $72,000 is an
additional request, there will be a problem.
DPW Hammer stated the Public Works Department has not yet received written confirmation
• from WQB in regard to the City utilizing the appropriated dollar amount for the patch
back and have City forces reconstruct the streets. The percentage would have to be
based upon T, D & H's estimate for the patch back, which was approximately $117,000.

the City rebuilds the streets and does not construct
either
ditches or curb and
gutter the life expectancy is substantially
less than is designed.
C. Gunnerson questioned if curb and gutter was included in the original figure.
DPW Hammer stated the funding was never made available. A decision was never made.
He had provided $72,000 in the Storm Sewer budget and notified the Council during
budget hearings that there is $38,000 in the 1988-89 budget and another $34,000 to
be allocated in the 1989-90 budget.
Surveyor Zavodny stated the decision has to be made before going out for bid, of
which advertising will occur within 30 days.
The Committee made the decision to place SW Kalispell Project as the only item on
and Sewer Committee

EXTENSION REQUEST - FIRST ALLEY WEST Mayor Kennedy stated he has received a Contract
Extension Request from Chet Brown & Sons, Contractor for First Alley West Improvements,
for the City of Kalsipell and read the same.
Dave Brown of Lewistown, Montana, President of Chet Brown & Sons, Inc., stated the
extension request is based upon the following: 1) Initially the sewer line was run
at a given depth and discovered some of the pump stations could be eliminated by
• lowering the sewer main by approximately one foot which required one week's time,
2) In the alley between 1st and 2nd St. there was concrete alley below the paved
alley from 8" to 16" thick which required time in removing before the construction
could begin in this area, 4 days of time, 3) Changes by utility companies in locations
of vaults, location of lines, delayed conduit installation by one week, 4) Street
lights, signal lights, and decorative light installation delayed concrete and asphalt
placement.
Mr. Billmayer stated they are in agreement and have signed the extension request.
C. Nystul requested the length of time the City caused by changes in the street
signal and decorative light conduit.
Mr. Brown stated installation time and placing of sidewalk in addition to conduit would
require more time.
Mr. Billmayer stated the Contract provides for liquidated damages and does not foresee
any changes in contract prices unless the City foresees any indirect costs levied by
the Contractor. He does not see any extra engineering costs associated with the
extension and is within their budget.
C. Gunnerson stated he will bring the Request for Extension to the City Council meeting
of November 7, 1988 for approval and Council action.
C. Nystul stated the lights which were added to the alley were not accompanied by a
• change order to date.
Mr. Billmayer stated a tabulation for the lighting costs is expected. If the summation
of the finalized quantities exceeds the contract amount, then a change order is
necessary.

EXTENSION REQUEST - FIRST ALLEY WEST Cont. Mr. Billmayer stated they have not
gone over the engineering inspection estimate to date and doesn't see this as a
factor. Billmayer Engineering and Chet Brown have requested confirmation from the
City regarding the cost for re -excavation of the alley to lay conduit after the
alley has been basically backfilled.
Mayor Kennedy has the letter prepared.
DECORATIVE STREET LIGHTS Mayor Kennedy stated the Chamber of Commerce and Uptown
Merchants Association has purchased Christmas decorations and have requested the
City to install a plug-in on each of the decorative street lights for installation
of the decorations. The funding is available in Tax Increment Street Lighting
Materials, an $8,000 budget. The four estimates received range from $41.50/pole
to $69.00/pole.. Community Development gave approval to expend the dollars.
C. Gunnerson stated this should go before City Council.
C. Nystul stated this was not technically budgeted for this purpose but it is
not a large expense and does not have an opinion either way.
C. Gunnerson will discuss this with other Councilmembers and will report the
decision to Mayor Kennedy before the City Council meeting of November 7, 1988.
PHOSPHOROUS REMOVAL C. Nystul questioned how far the Requests for Phosphorous
Engineering has progressed. Mayor Kennedy stated a meeting should be set for
discussion. Discussions have taken place with WQB regarding the possibility of
a request for one engineer. A time schedule has been prepared for this and believes
the City can go out for one engineer.
Mayor Kennedy stated the City has received confirmation of an extension for Interim
Phosphorous until April 15, 1989. If the Request for Qualifications and the
Request for Proposals for Interim Phosphorous were combined, the approximate $30,000
for materials for interim phosphorous removal would be grant eligible.
C. Nystul requested the Request for Qualifications go before this Committee for
review.
Mayor Kennedy stated he did not want this to hold up the process.
RAX C. Nystul questioned if a right-of-way permit was issued to the Rax construction
site and if the City has jurisdiction over the Department of Highways' right-of-way.
Surveyor Zavodny stated the City does not have jurisdiction over the right of way
but the local office generally requests it be built to City of Kalispell Standards
and the City ,does the inspection of the work.
C. Nystul questioned since the permit was issued and the City has implied jurisdiction
why are sawhorses and two-by-fours being used.
Construction Inspector Van Dyke stated he called Pack and Co., who obtained the permit,
after it was brought to his attention. Pack and Co. stated they were completed with
their portion of the work. Bob Ross is the General Contractor. He will prepare a
• letter to Ross Construction regarding non-compliance.
Surveyor Zavodny stated threatening letters are sent and generally contractors do not
comply. C. Nystul stated if necessary the City Attorney should take action.
