Others Present: City Attorney Neier, DPW Hammer, Fire Chief Waggener, W/S Supt. Hyde, • Ronnie Pack and Steve Cummings, Attorney. DEVELOPERS AGREEMENT City Attorney Neier and DPW Hammer explained the various revisions of the Developer's Agreement between Mr. Pack and the City of Kalispell. The Public Works Staff and City Attorney Neier have reviewed the agreement and have accepted it as proposed. City Attorney Neier pointed out the three documents within the Developer's Agreement which will require Mayor Kennedy's signature: 1) Dedication of Grant of Easement, 2) Gravity Main, and 3) Collector Line. The Committee will recommend to the City Council to accept the Developer's Extension Agreement and to authorize Mayor Kennedy to sign the three documents. 0 There being no further business to discuss regarding Mr. Pack's agreement, Mr. Pack and Mr. Cummings excused themselves from the meeting. CONWAY DRIVE DPW Hammer stated that a request from the drive-in bank for recommendation to close a portion of Conway Drive from Route 93 to the west edge of Claremont Street to on -street parking has already been to the Board of Adjustments. The Board of Adjustments has placed conditions on the conditional use permit for the drive-in bank. After some discussion, the Committee made the following recommendation: ecommend to the City Council for an in the decided area. VACANCY - FIRE DEPARTMENT Fire Chief Waggener requested the Committee to recommend to the City Council for the reinstatement of Tim Berg, who has obtained medical release, to fill the vacancy in the Fire Department. There being no further agenda items relating to Public Safety, Fire Chief Waggener excused himself from the meeting. WOODLAND PARK W/S Supt. Hyde explained that he has spoken to the Pizza Hut repre- sentative, who will be locating a Pizza Hut in the building next to the Scoreboard Bar, and has advised them of the annexation procedure, hookup fees and possible water main extension. In addition to the $500 per unit hookup fee there is a late- comers fee for people to tie onto the system that the residents in SID 337 paid for. An ordinance will have to be passed to formalize the additional charge. A recommendation was made to establish a late comers fee for all areas receiving service from the Woodland Park lift station who are out of the SID 337. Discussion took place in regard to extending the deadline for the residents who have not hooked onto the system -- to keep the hookup fee at $350 as an encouragement. •The Committee made the decision to recommend to the staff that the Committee is willing to allow the $350 hookup fee for a brief period providing the City has firm commitments that the residents will hookup before the end of the construction season. WATER SYSTEM - CONTROLS W/S Supt. Hyde reported that the water system controls fail regularly. Morrison-Maierle will review the bids and make a recommendation to the City for award. W/S Supt. Hyde stated the estimated cost for the system is $25,000 - $50,000 and has been budgeted for two years. Hyde reported that someone has applied for water rights to withdraw water out of Ashley Creek upstream of the treatment plant. The City has protested the rights. Although the person will be issued the rights to withdraw water, the City will have the documentation that states when any prior users call for water, this person will have to shut their pumps off. In addition, it may be specified that they cannot take water during July and August. NORTH VALLEY COUNTY SEWER DISTRICT C. Nystul stated his proposal to the Committee and to the staff that the users be sent a letter from the City regarding the maintenance of the lift station. A carbon copy should be mailed to School District 5 and the Flathead County Health Department. DPW Hammer stated that the City has tried to obtain a maintenance agreement and has been unable to do so since the Developers Agreement doesn't cover maintenance. He also recommended the City Attorney to be involved. The Committee made a recommendation to the for aDDroval.
