Chairmen Ruiz and Nystul and Councilmen Palmer, Hafferman, and Schindler
in attendance. Mayor Kennedy, ➢PW HAmmer, Sewer and Water Superintendent Hyde,
Construction Inspector Van Dyke, Street Superintendent Brady, Surveyor Zavodny,
Gary Christiansen, Dan Johns, Peter Larsen, Bob Sonntag, Alroy Barry, Dennis
Carver, Larry Davey, Carey Wyrick and Roger Hopkins fo the Daily Inter Lake
also present.
M 5 C TIRE SEWER AND WATER HOOK-UPS - DPW Hammer stated that he had taken
another look at this situation. It will cost Mr. Wyrick approximately $4,000
to hook up at this time, as well as tearing up the new Meridian Road. The
City Attorney has been asked about the legality of an agreement which would
state that if in the future a new owner takes possession the hook-up fees and
new line would have to be run to the main in Meridian Road. C. Palmer explained
that earlier planning for another building had been done and the line had been
stubbed out while Meridian was being rebuilt. C. Palmer moved that the hook-up
fees be waived subject to the city Attorney drafting an aacceptable agreement.
C. Schindler seconded and the motion passed. This will be presented to the
Council.
DAVEY'S USED CARS WATER LINE - Larry Davey explained the since street work
was done the water line has been freezing. It had not frozen before the street
was reconstructed. He has tried various solutions including heat tape and
attempting to work with the City but has had no satisfaction and no clear answers.
• He requested that the City lower the main or correct the problem in some way.
He also pointed out that there is a drainage problem in 1st Avenue West North.
C. Ruiz read a memo from Steve Cox to Supt. Hyde dadted June 16, 1986 which
indicated that the problem must be related to a difference in elevation. S/W
Supt. Hyde said the main in approximately 5' deep. He had talked with Surveyor
Zavodney who had said it was possible that up to 18" of clay was removed during
the reconstruction and replaced with pti run, but Supt. Hyde was not sure whether
that would make a difference. There has been no change in location or depth
of the service line and no other businesses on that main seem to have been
affected. DPW Hammer suggested that the Water Department check it out thoroughly
and if warranted perhaps Davey's could purchase the materials and the City
provide the labor. The Water Department will dig at the edge of the asphalt
(the farthest the ground would have been disturbed during reconstruction of
the street) and will make a decision. The Committee felt that if it is found
that it is the City's responsibility the City should cover the whole cost.
DR. STEVE JOHNSON SITE PLAN - DPW Hammer presented the latest site plan
and pointed out the 12' owned by Dr. Johnson and the 8' owned by Mr. Larson,
and the fire access that will be chained off at all times. He stated that
he felt this was the best site plan for all concerned. He shared a letter
from Dr. Johnson listing what he would do and what he would in turn like the
City to do. One of those items was to share the cost of paving the alley,
which DPW Hammer explained is a policy the Public Works Department has been
operating under. Dr. Johnson had verbally agreed to turn over the 12' of the
street presently owned by him to the City as part of the agreement to pave.
Gary Christiansen, attorney for Dr. Johnson, explained that the paving idea
had originally been suggested by the City but he felt it would help channel
• " the traffic if the paving extended only to the fire lane.

There was extended discussion of whether the chained off fire lane was
necessary. The neighbors have a concern that a year or two down the road someone
will petition to have that opened for traffic, but they would accept it
if there was an agreement in writing that would not allow that to take place.
The suggestion was made to move the landscaped island over to the east edge
of the 12' strip owned by Dr. Johnson so as to ensure that traffic did not
use the alley, but after consideration it was felt that would create a problem
for fire protection for the residents. Fire Chief Larson was called and after
looking at the plans he made some suggestions for redesigning the lot so as
to remove the chained off fire lane while still allowing good access. He also
went out for an on -site inspection and reported back that the plans would work.
The Fire Department has good access from both Wyoming and lst Avenue West.
Dr. Johnson will have new plans drawn showing the changes in fire access and
still meeting the requirements for number of parking spaces. These plans will
be shown to Fire Chief Larson for final approval.
DPW Hammer also asked for a change in the wording of ➢r. Johnson's letter
(#4) concerning the removal of -any encroachmenfs.---Clarification is needed. - -
C. Ruiz pointed out that any infringment of fence lines on private property
needs to be dealt with between the owners.
DPW Hammer stated that he would approve the site plan subject to Dr. Johnson
• deeding the 12' to the City and the City participating in the paving so that
the contractor may obtain a building permit.
RECONSTRUCTION OF LOTH STREET WEST - S/W Supt. Hyde listed projects that
need to be done with the funds left in order of priority: 1) 1st Alley West,
2) Purdy's Trailer Court Line (It is a mystery how some of the residences are
hooked in. Promises were made to obtain easements for Phase I and the City
must follow through on the committment. Remick's want to build a 4-plex next
a spring. Mike Fraser has estimates of the cost of correcting this situation
so that the line through Remick's property may be abandoned.) 3) Two catch
basin inlets tied into the sanitary sewer should be diconnected. 4) Trunk line
crossing football field could be changed from sanitary to storm to alleviate
the run-off onto the football field.
C. Nystul stated it was only reasonable to rebuild loth but he questioned
who is responsible for the curbing. It is his opinion that if the City does
the work they must replace the curbing, but if there has never been curbing
there it should be ordered in for the residents to pay for. Surveyor Zavodny.
explained that there are three sections of curbing in place but they would
have to be removed because they are upright and the street cannot be built
to fit the curbs. After discussion it was decided that the three blocks should
be excavated, the storm sewer installed; and the street should be brought up
to grade this fall and if it is not possible to finish the rest before the
bad weather sets in curbs could be ordered in this fall and curbing and paving
can be done in the spring.
• _ WHITEFISH SIDE -ARM LOADER BID - The Mayor received an invitation to bid
on the back-up side -arm loader owned by Whitefish. DPW Hammer stated that
his office had done some checking and the information received indicated that.
Whitefish wishes to sell only to a local entity who will, as part of the sale,

will agree to loan the loader to Whitefish in the case of a breakdown of their
regular truck. The Committee felt that the City should pursue an agreement
with Evergreen Disposal for a backup truck for our use, but under the circumstances
the City should not bid on the Whitefish truck.
SAND SPREADER - DPW Hammer asked for permission to go out on bids for the
purchase of a sand spreader so that it will be available for use this winter.
The Committee agreed.
FUEL SYSTEM - The Committee felt that DPW Hammer should prepare a presentation
for the whole Council. They also asked about the building needed at the City
Shop and DPW Hammer said he felt they needed to wait until after the election.
It was pointed out that the Sign Shop is in need of replacing and the City
needs to get moving on this.
GARBAGE DUMPSTER FOR BISSELL SCHOOL - Construction Inspector Van Dyke,
who is also on the board at Bissell School, explained that the trash container
at the school is badly in need -of replacement-,-but--that the school does not -
have the funds to replace it. He asked if one of the dumpsters which have
been replaced by the 400 gallon containers could be donated by the City to
the school. C. Ruiz stated that the white dumpster at the Golf Course was
available and they could have it if they would haul it away.
• SID #337 FUNDING - C. Nystul explained that the grant acceptance signed
by the Mayor states that the City has the funding to cover their portion of
the project. This money is available from the sewer capital improvement fund
until such time as the bond arrangements are made. The bid cannot be awarded
until the contract is approved by the EPA. The City was going to give a purchase
order to LHC so that they could get materials ordered, but discovered that
would not be grant eligible. So instead the City will give a notice of award
s so that LHC can get started.
