Chairman Palmer and Councilman Nystul in attendance. Ed Kennedy, DPW
Hammer, Parks Director Drent, Police Chief Stefanic, Surveyor Zavodny, Terry
Powell, Don Arthur, Tom Davis, Tom Heinecke, and Roger Hopkins of the Daily
Interlake also present.
GARBAGE CHARGES - TOM DAVIS - Mr. Davis stated that he appreciates the
garbage service but feels that if he must pay (he hauls his own garbage) every-
one else in the City should also have to pay, including the commercial units.
C. Palmer explained that the reason the City allows private pick-up for commercial
is because the City has not had the capacity for 2 - 5 times a week pick-up.
Mr. Davis also pointed out that if individuals and businesses can get City
sewer and water (even those outside the City limits) they should use and pay
for City garbage. There was some discussion of the policing problem.
C. Palmer told Mr. Davis that his comments were good ones and would be considered.
CITY RESPONSIBILITY FOR SIDEWALKS - This question arose because of complaint
calls concerning sidewalks adjacent to parking lots not being shoveled. Parks
Director Drent explained that his department does shovel some, and a little
more has been added each year. He would like a plain statement of his responsibility
or lack of it in this area so that he can plan. The Committee will meet with
the Parking Commission in a joint meeting January 14 at 2:00 P.M. to deal with
this. In the meantime the Parks Department will take care of the sidewalks
in question so that they will not be left undone.
WINDWARD WAY EASEMENT - Don Arthur, from the Second Wind, explained that
it was his understanding that the Council had approved the Windward Way subdivision
with the condition that 10' was dedicated to right-of-way on Windward Way.
He said they are more than willing to do that but there was a favor he wished
to ask of the City. The proposed road easement, which he felt had not been
dedicated to the City, on the west of his property, was originally intended
to serve the Buffalo Head Development and Developers Diversified. Mr. Arthur
said he and talked with Doug Johns, and stated that they were in a position
where they needed to acquire some land to the west. Mr. Johns stated that
the., only reason for the easement was because Windward Way was sub -standard.
All he needs is a letter from the City stating that with the additional width
being dedicated at this time to the improvement of Windward Way to a 50' easement
(no parking) it would satisfy the City's requirements for a secondary easement.
C. Palmer asked if they were planning to build a building and Mr. Arthur said
not at this point. The easement basically dead ends into the health center
complex, although they have acquired an easement to curve it over to Windward
Way if necessary. C. Palmer said that this would require an abandonment. There
was discussion of the proper procedure since it had not been dedicated to the
City, DPW Hammer and Surveyor Zavodny wanted to spend some time with this
and give a recommendation. They will also provide a sketch showing trafic flow
and future plan for the area. There was some question concerning set backs
in case of future building.
SECOND ALLEY WEST STREET LIGHT - There has been a request from several
residents and businesses for a light in this parking area. There was discussion
` of possible location in relation to other lights. The Committee directed DPW
1 Hammer that Street Lighting District funds could be used for this and asked
him to write a letter for the Mayor to sign authorizing PP&L to put up the
light.

KALISPELL HOTEL BUILDING ENCROACHMENT - Jay Billmayer said that the old
Kalispell Hotel has a stairwell on the west end of the building that is encroaching
on the alley by 4§'. This is the only major structural encroachment in the
5 blocks where the new sewer line is to be laid. This stairwell access is
not critical to the hotel. There was discussion of what was involved and the
cost. The Committee was concerned that it not be a burden to the hotel financially.
It was pointed out that during the Main Street reconstruction owners paid for
the blocking off of the walls but the backfill and removal of the concrete
was part of the reconstruction contract. It was decided that DPW Hammer would
give C. Saverud a rough draft of the policy from Missoula to consider, the
Building Department was to be consulted, and the backfill and removal of concrete
was to be part of the sewer project.
