SECTION 10. POWERS. The Kalispell City -County Planning Board shall possess and have all powers and authority granted by the provisions of Chapter 246 of the Laws of the Thirty-fifth Legislative Assembly of the State of Montana, 1957, and shall perform all duties required thereunder. SECTION 11. REPEALING CLAUSE. All ordinances and parts of ordinances in conflict herewith of the City of Kalispell are hereby repealed. FIXING THE PENALTY FOR VIOLATION THEREOF, DECLARING SAME TO BE AN EMERGENCY AND FIXING EFFECTIVE DATE, AND REPEALING ALL ORDINANCES OR PARTS THEREOF IN CONFLICT HEREWITH: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL: SECTION 1. Any person who shall not have reached the age of twenty-one (21) years and who shall have in his or her possession, beer or liquor shall be guilty of a misdemeanor. SECTION 2. Any person who is convicted of a violation of this Ordinance -will be punished by imprisonment in the City Jail for a period of not more than ninety (90) days, or a fine of not more than $300.00, or by both such fine and imprison- ment. SECTION 3. This Ordinance is hereby declared to be an emergency ordinance, and passed in the interest of public health, welfare and safety, and shall be in full force and effect upon its passage and approval. SECTION 4. All Ordinances or parts of Ordinances in conflict herewith shall be and the same are hereby repealed.
