Ordinance 663 - Creates City-County Planning Board123 ORDINANCE NO. 663 AN ORDINANCE CREATING IN CONJUNCTION WITH THE COUNTY OF FLATHEAD, MONTANA, THE KALISPELL CITY -COUNTY PLANNING BOARD PURSUANT TO AND UNDER THE PROVISIONS OF CHAPTER 246 OF THE LAWS OF THE THIRTY-FIFTH LEGISLATIVE ASSEMBLY OF THE STATE OF MONTANA, 1957; FIXING THE NUMBER OF MEMBERS CONSTITUTING SUCH PLANNING BOARD, THE METHOD OF APPOINTMENT OF SUCH MEMBERS, AND QUALIFICATIONS AND THE TERMS THEREOF: DEFINING THE POWERS OF SUCH PLANNING BOARD; PROVIDING FOR THE SUBMISSION OF AN ANNUAL BUDGET BY SAID PLANNING BOARD TO THE CITY COUNCIL OF KALISPELL, AND THE BOARD OF COMMISSIONERS OF FLATHEAD COUNTY; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION 1. CREATION OF BOARD. There is hereby created a combined City and County Planning Board pursuant to and under the provisions of Chapter 246 of the Laws of the Thirty-fifth Legislative Assembly of the State of Montana, 1957, to be designated and known as "The Kalispell City -County Planning Board." SECTION 2. BOARD MEMBERSHIP. The Kalispell City -County Planning Board shall consist of nine (9) members all of whom shall be qualified electors of the State of Montana and the County of Flathead. Two of such members shall be "official members" to be appointed by the Board of County Commissioners who shall be employed by or hold public office in Flathead County. Two of such members shall be "official members" who shall be appointed by the City Council of Kalispell, and who shall be employed by or hold public office in the City of Kalispell. Three of such members shall be "citizen members" who shall be appointed by the Board of County Commissioners of Flathead County. Two of such members shall be "citizen members" who shall be appointed by the Mayor of the City of Kalispell. SECTION 3. TERM OF OFFICE. Terms of the members who are officers of the City of Kalispell and the County of Flathead shall be coextensive with their respective terms of office to which they have been elected or appointed. The terms of the other members shall be four years, except for the term of the first members appoint- ed which shall be fixed by agreement and rule of the Board for any period of time from one to four years in order to provide for staggered terms with a minimum number of terms expiring in any single year; provided however, any citizen appointed may be removed from office by a majority vote of the governing body of the govern- mental unit represented by such appointee. Nothing herein contained shall prevent the re -appointment of a member whose term has expired. SECTION 4. VACANCIES. Vacancies occurring in citizen members on the Board at the end of the term shall be filled alternately by the Mayor and the Board of County Commissioners commencing with the Mayor. Vacancies occurring on the Board of official members, and by death or resignation of citizen members, shall be filled by the governing bodies having appointed them for the unexpired term. Absence from three (3) consecutive regular meetings of the Board shall constitute a resign- ation from the Board and upon request of the president such vacancy shall be immediately filled as above set forth. SECTION 5. QUALIFICATIONS OF CITIZEN MEMBERS. The citizen members shall be qualified by knowledge and experience in matters relating to the development of the City and County. SECTION 6. MEETINGS. The Board shall fix the time for holding regular meetings but it shall meet at least once each month during the year. SECTION 7. OFFICERS. As soon as practicable after their appointment the Board shall meet and organize by electing a President, and a Vice -President. ' SECTION 8. BUDGET. At the proper time as required by law the Board shall submit to the County and the City a budget of its requirements for the fiscal year, which said budget shell be approved by the Board of County Commissioners and the Council of tha City. In case of a disagreement between said County and City, as to the budget submitted, the same shall be submitted to a committee composed of the Board of County Commissioners and three members of the Council of the City, who shall then make such recommendations to their respective governmental units as may be agreed upon. SECTION 9. EXPENSES, PAYMENT, STATEMENT. All expenses of the Board shall be contribut6d to by the County and the City in such proportions as may be agreed upon by the Council of the City and the Board of Commissioners, but any funds so appropriated by the County shall be paid to the City Treasurer who shall disburse the same as City's Funds. All receipts of said Board shall be paid to the City and County in the proportion so agreed upon. The City shall not not less than once 124 �D every three months submit to the County a detailed and itemized statement of receipts and disbursements and all unexpended budget balances. SECTION 10. POWERS. The Kalispell City -County Planning Board shall possess and have all powers and authority granted by the provisions of Chapter 246 of the Laws of the Thirty-fifth Legislative Assembly of the State of Montana, 1957, and shall perform all duties required thereunder. SECTION 11. REPEALING CLAUSE. All ordinances and parts of ordinances in conflict herewith of the City of Kalispell are hereby repealed. FIXING THE PENALTY FOR VIOLATION THEREOF, DECLARING SAME TO BE AN EMERGENCY AND FIXING EFFECTIVE DATE, AND REPEALING ALL ORDINANCES OR PARTS THEREOF IN CONFLICT HEREWITH: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL: SECTION 1. Any person who shall not have reached the age of twenty-one (21) years and who shall have in his or her possession, beer or liquor shall be guilty of a misdemeanor. SECTION 2. Any person who is convicted of a violation of this Ordinance -will be punished by imprisonment in the City Jail for a period of not more than ninety (90) days, or a fine of not more than $300.00, or by both such fine and imprison- ment. SECTION 3. This Ordinance is hereby declared to be an emergency ordinance, and passed in the interest of public health, welfare and safety, and shall be in full force and effect upon its passage and approval. SECTION 4. All Ordinances or parts of Ordinances in conflict herewith shall be and the same are hereby repealed.
