ORDINANCE NO. 654
AN ORDINANCE PROVIDING FOR THE CREATION OF A PLANNING COMMISSION IN THE CITY OF
KALISPELL, MONTANA, DESIGNATING THE MEMBERSHIP THEREOF AND THE TERM OF OFFICE
OF SUCH MEMBERS, PROVIDING FOR THE OFFICERS OF SUCH COMMISSION AND THEIR TITLES
AND DUTIES, PROVIDING FOR THE HOLDINGS OF MEETINGS BY SAID COMMISSION AND ➢EFINING
A QUORUM FOR SUCH MEETINGS AND DESIGNATING THE POWERS AND RESPONSIBILITIES OF
SAID COMMISSION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA:
SECTION 1. CREATION -- MEMBERSHIP: There is hereby created in the City of
Kalispell, Montana, a Planning Commission hereinafter referred to as the
"Commission", which shall consist of nine (9) members who shall be appointed
by the Mayor, with the approval of the Council of said City, provided, however,
that one of said members so appointed shall be a member of the Council of said
City, the remaining eight (8) members to be public spirited taxpayers and electors
of the City of Kalispell.
SECTION 2. TERM: The terms of the members of said Commission shall be for four
(4) years, save and except the member from the Council of said City who shall serve
for one (1) year, provided, however, that four (4) of the original members shall
be appointed for a term of two (2) years commencing with the 15th day of May, 1957,
and the remaining four (4) members shall be appointed for a term of four (4) years
from said date. At the first regular meeting of the Council in May of each year
in which the terms of said members expire, or as soon thereafter as practicable,
said Mayor shall appoint four (4) members of said Planning Commission plus the
member from the City Council to replace those whose terms shall have expired.
Nothing herein contained shall prevent the reappointment of a member whose term
has expired.
SECTION 3. OFFICERS: Immediately after the appointment by the Mayor of any
members in May of each appointive year, said Commission shall meet and from its
members shall be elected a Chairman, Vice Chairman, and Secretary, who shall
hold their offices respectively for two (2) years. The Chairman, and in his
absence, the Vice Chairman, shall preside at all meetings and perform such other
duties as shall be required and directed by said Commission. The Secretary, or
in his absence, a member designated by the Commission, shall keep accurate minutes
of all proceedings of said Commission in a book provided for that purpose, to be
called, "Records and Minutes of the Planning Commission of the City of Kalispell."
SECTION 4. MEETINGS: All meetings of the Commission shall be called by the
Chairman of said Commission at a time and place to be designated by him, provided,
hbwever, that said Commission shall meet at least once each calendar quarter. At
least twenty-four (24) hours' notice of all meetings shall be given. Any member
' who shall have received such notice but who shall be absent from four (4) consec-
utive meetings without adequate excuse, shall be automatically dropped from said
Commission and a new member appointed to fill his unexpired term. A majority of
all members of the Commission shall constitute a quorum for the transaction of
business. In all parliamentary practice not herein provided for, "Roberts' Revised
Rules of Order" shall govern.
SECTION 5. FUNCTIONS: Said Commission shall make a study of and develop plans
for the improvement and development of such municipal functions and facilities as,
(1) streets, (2) parks, (3) sites for public buildings, (4) public reservations,
(5) zoning, (6) public utilities, (7) additions to the City, and other matters
related thereto. Upon having made such acstudy of any such matter and having

developed a plan or proposal relative thereto, said Commission shall have power
to recommend to the Council of said City that such plan or proposal be adopted
and appropriate action taken thereon, In the event that said Council chooses not
to adopt such plan or proposal or to take affirmative, favorable action relative
to such plan or proposal, it shall return said plan or proposal to the Planning
Commission within thirty (30) days or submission of the same, together with a
statement of the reasons why favorable action has not been taken thereon.
SECTION 6. This Ordinance shall be in full force and effect thirty (30) days
from and after its passage and approval.
SECTION 7, Passed by the City Council and approved by the Mayor this 7th day
of January, 1957.
