AN ORDINANCE AMENDING ORDINANCE NO. 633, PASSED AND APPROVED BY THE CITY OF
KALISPELL, MONTANA, JULY 12, 1954, AS TO RECLASSIFICATION OF BLOCK ONE -A OF
DUNCAN ADDITION, BLOCKS NO. 19, 26, 27, 28, AND WEST HALF OF BLOCK 20 OF
CAMERON ADDITION, AND THE INCLUSION OF BECKER ADDITION, GOLF COURSE ADDITION NO. 23
BLOCKS THREE AND FOUR OF ASHLEY TOWNSITE, AND A TRACT ON MERIDIAN ROAD AS FURTHER
DESCRIBED BELOW, REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT
AND DECLARING AN EMERGENCY.
WHEREAS, The Board of Adjustment of Kalispell, Montana, gave notice of a public
hearing on proposed changes in the zoning regulations, which notice was duly
published pursuant to law in the Daily Inter Lake, a daily newspaper printed in
Kalispell, Montana, such publication being on September 10, 1956, as shown by the
affadavit of publication duly filed with the clerk of such Board of Adjustment,
and such Board duly held such hearing pursuant to such notice on the 27th day of
September, 1956, and,
WHEREAS, after due consideration, the said Board of Adjustment caused this
ordinance to be prepared and presented to the City Council of the City of Kalispel 1,
Montana, with recommendation that it be passed and adopted by said City Council,
and,
WHEREAS, it appears that the proceedings of the Board of Adjustment have been in
conformity with the ordinances of the City of Kalispell, and the laws of the State
of Montana, and it appearing that this ordinance was presented to said Council on
the first day of October, 1956, and that over ten days have elapsed since such
time, and that it will be to the best interest of the City of Kalispell to adopt
such ordinance as proposed,
NOW 'THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA.
'THAT Ordinance No. 633 of the City of Kalispell, Montana, be and the same is
hereby amended as follows:
SECTION 1. That Block one -A of Duncan Addition be re -zoned from No. 3 residence
zone to No. 5 Business -Residence zone. That Blocks 19, 26, 27, 28, and the West
half of Bloch 20, of Cameron Addition be re -zoned from No. 3 Residence to No. 2
Residence zone.
SECTION 2. That Becker Addition be zoned No. 2 residence, Golf Course Addition
No. 2 be zoned No. 1 residence, Blocks three and four of Ashley Townsite be zoned
No. 3 residence. The following described tract be zoned No. 2 residence:
A tract of land in the Southeast Quarter of the Northeast Quarter of Section
13, Township 28 North, Range 22 West, described as follows; starting from
a point where the North boundary line of said Southeast Quarter of the North-
east Quarter intersects the West boundary line of the Meridian Road; thence
South, along the West boundary of the Meridian Road, a distance of 1030 feet
to the true point of beginning of the tract herein described, thence contin-
uing South, along said West boundary of the Meridian Road, a distance of
108 feet, thence at right angles Westerly, a distance of 150 feet, thence
at right angles Northerly, a distance of 108 feet, thence at right angles
Easterly a distance of 150 feet, more or less, to the true point of beginning.
SECTION 3. All ordinances and parts of ordinances in conflict herewith, are hereby
repealed.
SECTION 4. An urgency and emergency is declared to and does exist. -
SECTION 5. This ordinance shall be in full force and effect from and after its
passage and approval.
PASSED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA,
THIS 5TH DAY OF NOVEMBER, 1956.
