ORDINANCE NO. 648
AN ORDINANCE PROVIDING FOR SICK LEAVE FOR CITY EMPLOYEES
BE IT ORDAINED BY THE CITY OF KALISPELL, MONTANA
SECTION 1. SICK LEAVE - EFFECTIVE JULY 1, 19514, every regular City employee,
excepting members of the City Fire Department, who is unable to perform his or
her duties by reason of illness, shall be entitled to 11 working days of sick
leave with pay for each full calendar month of service, and any such sick leave
accrued and unused in any year shall be cumulative for succeeding years up to
a maximum of 90 working days, subject to the following conditions:
(1) No payment for absence due to sickness shall be allowed unless such
employee fulfills these requirements: (A) notifies his superior by telephone
or otherwise on his first day off duty; (B) fills out the required form as
ap lication for sick leave, within twenty-four hours after hisreturn to duty;
(C� furnishes upon request of his superior or the Mayor or City Council,
evidence of his illness or medical treatment.
(2) Sick leave with pay in excess of four consecutive working days for reason
of illness or physical incapacity shall be granted only after presentation of
a written statement by a reputable physician certifying that the employee's
condition prevented him from performing the duties of his position.
(3) Full time employees who have been in the employ of the City continuously
from July 19 1954, shall be credited with sick leave accumulation at the rate
of 14 days per month from said date, provided however, that no employee shall
be considered a full time employee until after six months of employment. Full
time employees employed after July 1, 1954, shall be credited with 712 days of
sick leave accumulation upon completion of six months continuous employment.
Seasonal and part time employees shall not be entitled to sick leave or any
accumulation thereof.
(4) Employees who are discharged or leave the employ of the City or are under
suspension, or are on leave of absence without pay, shall not receive sick
leave benefits, but in the event of return to work, shall to entitled to any
accumulation of sick leave credit established before such discharge, suspension
or withdrawal from City employment.
(5) An employee fraudulently obtaining sick leave, or a supervisor falsely
certifying to such sick leave payments for absence from work for other reasons,
may be suspended or discharged by the Mayor, or sick leave credits may be
cancelled by the Mayor with the consent of the City Council.
(6) An employee receiving sick leave pay who simultaneously receives compensation
from the State Workoen's Compensation Board shall receive from the City for the
duration of such compensation, but not to exceed his sick leave pay period, only
that portion of his regular salary which together with such compensation, equal
his regular salary.
(7) Applications for sick leave shall be made on forms furnished by the City.
Such applications shall be executed by the employee in duplicate, one copy for
the department head and one for the City Clerks office. The department head
shall attach his copy, with his approval thereon, to the department payroll, and
each department shall show on its monthly payroll, the employees claiming sick
leave, with the number of days claimed.
