ORDINANCE NO. 630
AN ORDINANCE PROHIBITING 'ME DISPENSING OF MOTOR FUEL BY SELF-HELP OR
COIN OPERATED PUMP OR DEVICE OR BY ANYBODY EXCEPT amR, LESSLE, OR
EMPLOYEE, PROVIDING QUALIFICATIONS OF ATTENDANTS, PROVIDING PENALTIES,
REPEALING CONFLICTING ORDINANCES, AND DECLARING AN EMERGENCY.
WHEREAS, the inflammability of gasoline and its explosive qualities
render it dangerous to life, health and property when handled by '
inexperienced and incompetent persons; and
WHEREAS, the proximity of gasoline -filling stations to other buildings
in the City of Kalispell creates a definite fire hazard in cases where
gasoline is dispensed by careless, inexperienced and incompetent persons; and
WHEREAS, it is necessary at all times for filling station operators to
be competent and qualified to handle gasoline and similar products; and
WHEREAS, the Council of the City of Kalispell, acting under its police
power, and for the protection of health and safety of the inhabitants, and
for the preservation and protection of property within said city, deems it
necessary to pass this ordinance; NOW THEREFORE:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KALISPE L, MONTANA:
Section 1. No gasoline or other motor fuel shall be dispensed at or
in any automobile filling station or any public filling station or other
place of business by any self-help or any coin operated pump or other
dispensing device, or by any other person other than the owner, lessee,
or a duly authorized attendant employed by such owner or lessee for such
purpose.
Section 2. Such owner, lessee or employee of the owner or lessee
shall be physically competent to act in an emergency, fully instructed '
regarding safety precautions, and shall comply with approved standards of
safety in handling gasoline and other inflammable liquids.
Section 3. The violation of any of the provisions of this ordinance
is declared to be a misdemeanor punishable upon conviction thereof by a
fine not exceeding :g"100.00 or by imprisonment for not more than 30 days,
or by both such fine and imprisonment. Each violation hereof shall constitute
a separate offense.
Section 4. All ordinances and parts of ordinances in conflict here-
with are hereby repealed.
Section 5. An urgency and emergency is hereby declared to, and does
exist and this ordinance shall become effective from and after its passage
and approval.
Passed by the City Council of the City of Kalispell this 15th day of
March, 1954.
Approved by the Mayor of the City of Kalispell, Montana,
this lith day of March, 1954.
