AN ORDINANCE PROHIBITING THE DISTRIBUTION OF HANDBILLS ALL OTHER ADVERTISING
MATTER ON THE STREETS AND PUBLIC PLACES WITHIN THE INNER FIRE LLNITS OF THE
CITY OF KALISPELL, DEFINING "PERSONS", DECLARING SUCH DISTRIBUTION TO BE
A NUISANCE, PROVIDING FOR PENAL'I'IES, AND REPEALING ANY ORDINANCES IN CONFLICT
THEREWITH.
' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL:
Section 1. No Handbills, Etc., to be Distributed, Where. It shall
be unlawful for any person to circulate, distribute, or hand to any person,
or scatter about or throw or place any handbills, circulars, advertisements,
or cards or any other advertising matter whatsoever, not included in the
foregoing, which is of such nature or character, that it will ordinarily
result in the littering of streets, sidewalks or other public places, in
or upon any of the streets, avenues, alleys, sidewalks, public places, or
vehicles on any of the aforesaid highways or places, within the inner fire
limits of the City of Kalispell, Montana, to -wit: That area bounded on
the north by Railroad Street, on the east by Second Alley East, on the
south by Fourth Street, and on the west by Second Alley West, and also that
area bounded on the north by Fourth Street, on the east by First Alley
East, on the south by Fifth Street, and on the west by First Alley West.
Section 2. Same -- "Person" Defined. The word1berson" in this
ordinance shall mean and include persons, associations, partnerships..
corporations, and any other organization, and their lessees, trustees,
and receivers, either as principal, agent, or employee.
Section 3. Same -- A Nuisance -- Abatement. The doing of any or all
of the acts herein prohibited is hereby defined to be a nuisance, which may
be abated in the manner of any nuisance.
Section 4. Same -- Penalty. Any person violating any provision or
provisions of this ordinance shall be subject to a fine of not less than
one dollar nor more than one hundred, fifty dollars.
Section 5. Any ordinances or parts of ordinances in conflict here-
with 'are hereby repealed.
Section 6. This ordinance shall be in full force and effect 30 days
from and after its passage and approval.
PASSED by the City Council of the City of Kalispell, Montana,
this 1st day of March, 1954.
APPROVED by the Mayor of the City of Kalispell, Montana, this 1st day
