ORDINANCE NO. 627
AN ORDINANCE REGULATING THE PARKING OF MOTOR VEHICLES BETWEEN THE HOURS
OF 2:00 A. M. AND 8:00 A. M. AT PLACES EQUIPPED WITH PARKING METERS,
EMPOWERING THE CHIEF OF POLICE TO REGTTLA'TE PARKING ELSEWHERE WITHIN THE
CITY LIMITS IPi ORDER TO FACILITATE SNOW PLOWING, PROHIBITING THE STORAGE
OF MOTOR VEHICLES NOT IN CONSTANT USE ON THE PUBLIC STREETS, ESTABLISHING
A FIRE LAME ON THIRD STREET EAST, EMPOWERING THE POLICE TO ;LOVE AND/OR
IMPOUND MOTOR VEHICLES PARKED OR rL,FT IN VIOLATION HEREOF AND TO ASSESS
THE COST THEREOF AGAINST THE OVER AND/OR OPERATOR THEREOF, PROVIDING FOR
THE MOVING OF PARKED MOTOR VEHICLES WHEN NECESSARY FOR LOADING OR UNLOADING
COMMODITIES, PROVIDING FOR PENALTIES, PROVIDING THAT THIS ORDINANCE BE
CONSTRUED IN CONJUNCTION WITH THE PARKING METER ORDINTANCE, REPEALING SECTION
330 OF THE REVISED ORDINANCES OF 1947, ORDINANCE NO. 604, AND ALL CONFLICTING
ORDINANCES, AND DECLARING AN EM,RGENCY.
WHEREAS, it is necessary* to regulate night-time parking in the congested
business district in order to enable the city to plow and remove snow and
clean the streets, and in the rest of the city to enable the city to properly
plow snow from the streets, and
WHEREAS, it is necessary to establish a fire lane on Third Street East
to speed the passage of fire trucks,
NOW THEREFORE: In order to promote the health and safety of the City
of Kalispell and to regulate traffic,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA:

vehicles except in accordance with the following schedule:
Parking allowed as follows:
Sundays
Mondays
Tuesdays
Wednesdays
Thursdays
Fridays
Saturdays
on avenues
on streets

on avenues
Streets mean all streets running easterly and westerly; avenues mean all
streets running northerly and southerly.
(b) The Chief of Police shall cause to be affixed to each parking
meter printed directions specifying when parking is allowable in accordance
with the foregoing schedule.
Section 2. Night-time parkin at places not equipped with parking meters.
(a) That between the hours of 12:00 midnight and 8:00 A. M. on all
streets and avenues in Kalispell not equipped with parking meters, there shall
be no parking of motor vehicles during periods of snow plowing as designated
by, or under the authority of the Chief of Police of Kalispell, except in
accordance with the following; schedule:

(b) The Chief of Police, upon the advice of the City Engineer,
shall designate periods of snow plowing, and shall give such periods
publicity by at least one publication in a newspaper published in
Kalispell and by at least three radio announcements over the -local radio,
and by posting on the bulletin board at the City Hall, each of such notices
to be given at least one day before the period begins, not including the
day on which such restricted parking begins.
Section 3. Storage of Motor Vehicles on the Public Streets.
(a) It shall be unlawful for any owner, person, partnership or
corporation to store or leave upon the streets (including avenues) of
Kalispell, any motor vehicle for indefinite periods of time; it is the
intent hereof that no motor vehicle shall be parked or left on such streets
unless it is in constant use. Any motor vehicle not used at least once
every 12 hours shall be deemed to be stored in violation hereof. Any
person leaving upon any street any motor vehicle not in running condition
shall be deemed prima facie guilty of a violation hereof, which may be
rebutted only by a showing that such motor vehicle had just broken down and
such person had not ,yet had time to remove it from the street. The owner
of such a vehicle shall be responsible for a violation hereof as well as
the person so leaving it.
Section 4. Fire Lane on Third Street East. There shall be no park-
ing cT any motor vehicles at any time on the south side of Third Street
from the alley between First Avenue East and Second Avenue East to Woodland
Avenue and such portion of Third Street East shall be designated as a fire
lane in order to enable fire trucks more unobstructed passage thereon,
as well as to alleviate the general congestion of traffic on such street.
Section 5. Removal of Motor Vehicles from Streets, - Assessment of
Costs.
(a) Any motor vehicle parked or left in violation of this ordinance '
may be moved by or under the authority of any police officer who shall
certify the cost thereof to the police judge who shall add the amount there-
of to any fine assessed against the owner or operator of such vehicle for
the violation thereof.
(b) Such motor vehicles may be moved to any parking lot provided by
the police, or to a local garage for'outdoor storage.
Section 6. Moving of Motor Vehicles to Permit Loading or
of Com%odities.
(a) Whenever the ,space occupied by a parked motor vehicle is necessary
for loading or unloading some commodity, the owner or operator of such
vehicle shall move 4wa7 from such space upon request of a police officer.
However, such vehicle may not be moved by or under the direction of such
police officer unless such vehicle is then parked in violation of the
Ordinance of Kalispell.
Section 7. Penalties. Any person who shall violate any of the
provisions of this ordinance shall, upon conviction thereof, be subject
to a fine in any amount not exceeding $50.00.
Section 8. Construction. This ordinance shall be construed in
conjunction with the Parking Meter Ordinance, viz: Sections 387 to 401 of '
the Revised Ordinances of 1947 as now or hereafter amended.
Section 9. Repealing. Section 330 of the Revised Ordinances of 19472
Ordinance 0 , and all ordinances and parts of ordinances in conflict here-
with are.hereby repealed.
Section 10. Emergency Declared. An urgency and emergency for this
ordinance is hereby delcared to and does exist and the same shall take
effect and he in force from and after its passage and approval.
