THE STATE OF MONTANA; SAVING THE PROVISIONS OF SECTION 25-508, R.C.'t., 1947; PROVIDING THAT SUCH TRAVEL SHALL BE BY PUBLIC TRANSPORTATION EXCEPT WHEN USE OF PRIVATE. AIJTOMOBILI?-OR AIRPLANE IS AUTHORIZED BY THE CITY COUNCIL; PROVIDING THAT ONLY ONE SUCH OFFICER AND/OR EMPLOYEE MAY CLAIM REIMBURSEMENT WIZEN TKO OR MORE TRAVEL JOINTLY IN THE SAME AUTO- MOBILE OR AIRPLANE; PROVIDING FOR CLAIM OF SERVICE ALLOWED FOR TRAVEL. BY PUBLIC TRANSPORTATION; PROVIDING FOR FORM AND CONTENTS OF CLAIM MADE 13Y SUCH OFFICER AND/OR EMPLOYEE FOR SUCH PER DIEM, MILEAGE OR ITEM ALLOWABLE UNDER SECTION 25-508, R.C.M., 1947; REPEALING ALL OR- DINANCES IN CONFLICT HEREWITH AND REQUIRING THAT CITY COUNCIL APPROVAL BE REFLECTED IN MINUTES OF MEETING WHEN GRANTED. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, AS FOLLOWS: SECTION 1.- Any officer or employee of the City, or any department thereof, who shall be .requirnd to travel outside the City on the of- ficial business of the City, and, who doeq so travel with the prior approval of the City Council, shall be allowed, for the t me engrig(id in such travel, the sum of Thirteen Dollar:, arl Fifty Centr-(a3.50) per day for such travel within the State of Montana, and the sum of Twenty Two Dollars and Fifty Cents ($22.50) per day for such travel, outside the State of Montana. Such per diem allowance shall be in lieu of any claim by such officer or employee for actual expenses in- curred while on such travel for meals, lodging or any other necessary expenses; provided however,.this Section shall not effect the ability of the City Council to allow membership fees or dues and other neces- sary expenses as.permitted in Section 25-508; Revised Codes of Montana, 1947. SECTION 2. In computing the per diem in lieu of subsistence for con- tinuous travel or more than twenty four (24) hours, the calendar day, midnight to midnight, shall be the unit, and for fractional parts of a day at the commencement or ending of such continuous travel, con- stituting a travel period, one-fourth (1/4)of the rate for a calendar day shall be allowed for each period of six (6) hours or fraction thereof. When a change in the per diem rate is made during a day, the rate of per diem in effect at the beginning of the quarter in which the change occurs shall continue to the end of such quarter. For con- tinuous travel of twenty-four (24,) hours or less, constituting a travel period, such period shall be regarded as commencing with the beginning of the travel and ending with the completion thereof, and for each six (6) hour portion of the period or fraction.thereof one fourth (1/4) of the rate for a calendar day shall be allowed; provided, however, that no per diem, excepting an allowance not to exceed one dollar and twenty-five cents ($1.25) per day for moneys. actually expended for mid -day meals, shall be allowed when the departure is at or after 8:00 A.M. and the return on thesameday is at.or prior to 6:00 P.M. In no case shall any per diem or allowance whatsoever be paid for any absence not exceeding three (3) hours. SECTION 3. All travel performed by City officers or employees hereunder , shall be by public transportation, provided, however, if the City Council dedms it to be more practical and in the best interest of the City to permit such officer or employee to use his personally owned automobile .or airplane travel by such means may be authorized by the 3N i f a WhOHt((S 4i9ee1 }ti owest class air travel avai.lab a only sha�l ballowed or :first clan: rail'.fairlshall.befAllowed with Pullman sleeping accomodataons allowed 251. only if overnight travel is necessary. Officers or employees util- izing public transportation shall furnish receipt stubs for such public transportation as attachments to expense vouchers submitted hereunder. SECTION 4. Any officer or employee of the City performing travel outs.i,te. the City as provided herein and wh-, with the prior author- ity of the City Council, Nall use hi own automobile or airplane for such travel shall he e;-titled to i.iileage therefor at the Cite of 9C per mile for thr ' direct or pracLical route- . by automobile or at the rat-.•, of 12C per air mile for the distance by the most direct or practical route by airplane; provided, however, that if two or more City officers or employees travel together in the same automobile or airplane only one of said officers or employ- ees may claim mileage for said travel so jointly performed. For mile. and route computation purposes under this section the latest edit- n of the Rand-`4cNally map shall be utilized, actual speedometer rcaJ i.wfs notwithstanding. SECTION 5. when approval of the City Council is required hereby, said action shall be reflected in the minutes of the meeting of said council at which such approval is granted. SECTION 6. Every City official or employee making a claim for per diem or mileage reimbursement hereunder shall submit a claim period- ically to the City Clerk on voucher form therefor provided showing a schedule of amounts claimed for such period; such schedule shall reflect accurate times, of departure from and return to.the City limits, mileage traveled each day of said travel.with points of departure and arrival noted, in what capacity such claimant was engaged each day or portion thereof while absent from the City, and the amount of per diem allowance, transportation fare, mileage, or other expense item that may have been authorized and allowed under Section 25-508, R.C.M., 1947, and the date of the meeting of the City Council at which such travel and means thereof were authorized. Such voucher shall be cert- ified by the claimant in the same manner as are other vouchers for claims against the City. SECTION 7. All ordinances of the City of Kalispell, or parts, thereof, in conflict herewith are hereby repealed.
