ORDINANCE NO. 734 d
AN ORDINANCE AMENDING SECTION 11-11 OF THE CODE OF THE CITY OF KALISPELL,
MONTANA.
BE IR ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, AS
FOLLOWS:
Section 1. Section 11-11 of the Code of the City of Kalispell, Montana,
shall be and the same hereby is amended to read as follows:
Section 11-11. Garbage containers - duty to provide; Location; Speci-
fications.
It shall be the duty of every owner, occupant, tenant, or lessee, or any
of them individually, of any and every occupied building used for human habi-
tation or business purposes within the City of Kalispell, Montana, to provide
or cause to be provided suitable metal or approved plastic garbage cans of
not more than 30 gallon capacity and equipped with a tight fitting cover,
which shall be kept in place at all times. Said cans to be equipped with
handles so that they may be lifted and carried by one man. The owner, occu-
pant, tenant or lessee, or any of them individually, shall,; provide a rack
for such garbage can or cans, so constructed so that the wind or dogs will
not upset the can or cans and, if above ground, the rack shall have a plat-
form raised off the ground not more than two feet and shall be placed on
private property so as to abut on the alley line, except in those areas in
the City where there are no alleys and in such areas, garbage cans shall be
placed as to abut on the front street line with no obstructions between the
garbage can and the alley or street in order that said garbage cans can be
picked up without trespassing upon private property. Provided, however, if
In any particular case it becomes necessary for the garbage truck to travel
upon private property to render said service of garbage disposal, no liability
for damage to driveways, trees, lawns or shrubs shall accrue to the property
owner, as it shall be the duty of the property owner to provide adequate space
and suitable driveways to accommodate such service. All garbage cans and
racks shall be kept free of snow and ice as to be easily accessible for col-
lection.
Section 2. All other Ordinances or parts of Ordinances in conflict
herewith are hereby repealed.
Section 3. This ordinance shall be in full force and effect from and
after December 7, 1966.
