Ordinance 704 - Revision and Codification of CodeORDINANCE NO. 704 AN ORDINANCE OF THE CITY OF KALISPELL, MONTANA, ADOPTING A REVISION AND CODIFICATIOR OF THE ORDINANCES OF THE CITY OF KALISPELL ENTITLED "THE CODE OF THE CITY OF KALISPELL, MONTANA," PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THERE, WITH CERTAIN EXCEPTIONS, AND FOR OTHER PURPOSES HEREINAFTER SET OUT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION 1. There is hereby adopted by the City Council that certain Code entitled "The Code of the City of Kalispell, ipntana," containing dertain ordinances of a general and permanent nature as compiled, consolidated, codified and indexed in Chapters l to 26, both inclusive, of which Code not less than•three copies have been and are now filed in the office of the City Clerk. SECTION 2. The provisions of such Code shall be in force and effect on and after November 6, 1963, and all ordinances of a general and permanent nature adopted on or before June 3, 1963, and not contained in such Code are hereby repealed from and after November 6, 1963, except as hereinafter provided. SECTION 3. The repeal provided for in the preceding section of this ordinance shall not affect any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before November 6, 1963; nor shall it affect any prosecution, suit or proceeding pending or any judgment rendered prior to November 69 1963; nor shall such repeal affect any ordinance or resolution promising or guaranteeing the payment of money for the City or authorizing the Issue of any bonds of the City or any evidence of the City`s indebtedness or any contract or obligation assumed by the City; nor shall,it affect the annual tax levy; nor shall it affect any right or franchise conferred by ordinance or resolution of the City on any person,or corporation; nor shall it affect any ordinance adopted for purposes which have been consummated; nor shall it affect any ordinance which is temporary, although general in effect, or special, although permanent in effect; nor shall it affect any ordinance relating to the salaries of the City Officers or Employees; nor shall it affect any ordinance annexing territory to the City; nor shall it affect any ordinance naming, renaming, opening, accepting or vacating streets or alleys in�the City; nor shall it affect any ordinance relating to zoning; nor shall it affect sections 133 and 134 of the Revised Ordinances, 1947, City of Kalispell, relating to use of money of the Water Department to redeem outstanding bonds and interest on City warrants, respectively; nor shall it affect Ordinance No. 624, relating to the corporate limits of the City; nor shall it affect Ordinance No. 650, creating and establishing a special improvement district revolving fund; nor shall it affect any ordinance adopted on final reading and passage after June 3, 1963. SECTION 4. Whenever in the Code adopted by this ordinance or in any other ordinance of the City or in any rule, regulation or order promulgated by - any officer or agency of the City under authority duly vested in him or if any act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or the doing of any act is required or the failure to do any act is declared to be unlawful or an offense or a misdemeanor, where no specific penalty is provided therefor, the violation of any such provision of such Code or any other ordinance of the City or such rule, regulation or order shall be punished by a fine not exceeding three hundred dollars or imprisonment for a term not exceeding ninety days, or by both such fine and Imprisonment. Except where otherwise provided, every day any violation of such Code or any other ordinance of the City or such rule, regulation or order shall continue shall constitute a separate offense. SECTION 5. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance and the Code hereby adopted are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance or the Code hereby adopted shall be declared unconstitutional or otherwise invalid by the valid judgment or decree of a court of competent jurisdiction, such uncon- stitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance or the Code hereby adopted. BE If ORDAINED BY CHE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION 1. Section 4-19 is hereby amended to read as follows: It shall be the duty of all policemen and the poundmaster to seize and impound any dog found to be running at large in violation of this article. The owner of every licensed dog so seized shall be notified, by the police department, in writing, of the seizure within forty-eight hours thereafter. Notice shall be deemed sufficient when it identifies the dog by license number, states the date and place of seizure, is placed in a sealed envelope addressed to the owner of the dog at his residence as appears on the application for the current license, and is deposited in the 1'nited States mail with postage prepaid. Every licensed dog so seized shall be retained in the pound for five days after notice is mailed to the owner of the dog. At any time while such dog is so impounded, the owner or :keeper of the dog may redeem such dog by paying to the poundmaster the sum of five dollars, plus one and one-half ($1.50) dollars per day for each day or any part of a day during which such dog has been impounded, which shall be paid to the treasury by the pound - master. At the expiration of five days after notice shall have been mailed to the owner of the dog as herein set forth, the poundmaster is authorized to dispose of such licensed dog as in Section 4-20 provided for unlicensed dogs. (Ord. No. 666, Sect. 6.) SECTION 2. An emergency is hereby declared to exist and this ordinance shall be in full force and effect upon passage and approval.
