Ordinance 684 - Curfew for MinorsORDINANCE NO. 684 14 AN ORDINANCE AMENDING SECTIONS 1 AND 2 OF THAT ORDINANCE No. 643 OF THE CITY OF KALISPELL, MONTANA, WHICH SECTIONS MAKE IT UNLAWFUL FOR ANY MINOR UNDER THE AGE OF 18 YEARS TO VIOLATE CURFEW HOURS, AND MAKE IT UNLAWFUL FOR ANY PARENT, GUARDIAN OR OTHER ADULT PERSON HAVING THE CARE AND CUSTODY OF THE MINOR TO ALLOW OR PERMIT A MINOR TO VIOLATE SAID CURFEW HOUR. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, THAT SECTIONS 1 AND 2 OF ORDINANCE NO. 643 OF THE CITY OF KALISPELL, MONTANA, BE AMENDED AS FOLLOWS* SECTION 1. Curfew for minors-- Loitering of minors prohibited. It shall be unlawful for any minor under.the age of 18 years to loiter, idle, wander, stroll, operate a motor vehicle or play in or upon the public streets, highways, roads, alleys, parks, playgrounds, or other public grounds, public places and ,public buildings, places of amusement and entertainment, vacant lots, or other unsuper- vised places, on each and every Sunday, Monday, Tuesday, Wednesday and Thursday between the hours of 10:30 P.M, and 5:00 A.M. of the following day, official ' City time, and on each and every Saturday and Sunday between the hours of 1:30 o'clock A.M. and 5:00 A.M., official City time; provided, however, that the provisions of this section do not apply to a minor accompanied by his or her parents, guardian or other adult person having the care and custody of the minor, or, where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor.' SECTION 2. Provision as to lack of knowledge on part of parent. It shall be unlawful for the parent, guardian, or other adult person having the care and custody of a minor under the age of 18 years to allow or permit such minor to loiter, idle, wander, stroll, or play in or upon the public streets, highways, roads, alleys, parks, playgrounds, or other public grounds, public places and public buildings, places of amusement and entertainment, vacant lots or other unsupervised :places, between the hours of 10:30 P.M. and 5:00 A.M. of the following day, official City time, on each and every Sunday, Monday, Tuesday, Wednesday, and Thursday, and between the hours of 1:30 A.M. and 5:00 A.M., official City time, on each and every Saturday and Sunday; provided, however, that the provisions of this Section do not apply when the minor is accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian, or other adult person having the care and custody of the minor.
