The meeting was called to order by Mayor. Kennedy with Commission Members
Schindler, Furlong, Clark and Nei.er present. Also attending were Betty az;d
Robert Van Riper, ClerkMeasurer Halver and Detective Young.
1. Diamond Lil Inn
Mayor Kennedy opened discussion on the application of Betty and Robert Van
Riper for a Gaming License at the business known as DiaRs nd Lil Inn.
Kennedy reported the Police Department investigation provided a clean report.
Robert Van Riper reported their intention was to install 6 to 7 Keno Machines
in the lounge area of the business.
Councilman Schindler moved approval of the Gaming License for Diamond Lil
Inn, City Attorney Meier seconded and the motion carried.
2.. Cavanaugh's - Free Keno
Mayor Kennedy reporter. Kent Frampton wanted to offer free plays on a Keno
Machine with the payoff for getting eight numbers progressing from $550.00 to
$1,000.00.
Ron Young reported the County Attorney said there was no payoff limit if
there was no wager made. He will ask for a specific opinion from the County
Attorney.
The comatission agreed the machine woulr, have to be licensed.
3. State Gaming Advisory Council
Mayor Kennedy repotted the council is considering a State Gaming Commission
which would provide uniform statewide regulation and licensing. The state
would collect the revenues and remit to the cities.
4. City Liability
Chief Clark asked if the city could be held liable if a licensee does
something illegal. City Attorney Neier said no.
5. License Denial Authority
Chief Clark asked if a license could be denied if the applicant's record was
questionable but there were no felonies on the record.
The group concluded grounds for denial must be based on what is in the Gaming
Rules. They also decided the enployer is responsible for checking out his
employees.
6. Reference Letters
The Police Department is having problems getting the reference letters
returned. It was suggested a signed acknowledgement by the applicant be sent
with the requests.

• City Attorney Neier felt the reference letters were useful even though they
can't be used as a basis for denial. He said they can indicate a need for
further investigation.
If an applicant has been found. to have lied on the application he can be
prosecuted for making a false statement and the City Attorney would
prosecute.
7. Machine Licenses
Chief Clark suggested the gaming machines should have city sticker licenses
attached to each machine. Young said the department investigation showed 16
machines were not licensed by the city.
Clark also requested the council provide scare more overtime in the budget so
the department can do more enforcement work on gambling.
Thew also needs to be a fine established in the ordinance to enforce the
machine licensing.
