• Chairman Palmer and Councilman Saverud in attendance. Mayor McDowell,Chief
DPW Hammer, Surveyor Zavodny, Construction Inspector Van Dyke, Scott Rose
of FVCC, John Franklin of Northwestern Telephone Systems, Herb Sandon of Sandon
Construction, Roy and Ruth Ross, and Clarence and Grace Hanson also present.

FENCE ENCROACHMENT ON CENTER STREET : CLARENCE AND GRACE HANSON - Their
fence was encroaching about 8". There was no letter of notification of the
problem but the contractor, Herb Sandon spoke with them before anything was
done. He took down the fence and will put it back up at 13 4th Avenue West.
RAY AND RUTH ROSS who live at 3 5th Avenue West (Corner of 5th and Center)
also had a problem with a fence encroaching, lilac bushes which are right
on the line, and a problem of a drop-off on the driveway with the road construction.
The Committee agreed that the fence, which was damaged, will be replaced and
the City wi11 deal with the contractor. The City will assume responsibility
for having the lilac trees relocated and the driveway regraded. Construction
Inspector Van Dyke was to see to these items immediately so that the sidewalk
can be poured. The Ross's asked about snow removal since there will be no
boulevard, and the Mayor told them to shovel the sidewalk snow out into the
street to be picked up by the Street Department crews.

NORTHWESTERN TELEPHONE PARKING LOT STORM SEWER - John Franklin presented
a proposal for a storm sewer for the parking lot at 20 1st Avenue East. It
will be necessary to remove a small piece of sidewalk during the construction,
which will be replaced. The alley will be paved. The street will not need
to be disturbed. C. Palmer asked that Mr. Franklin provide a letter stating
• his intentions that could be read at the November 4 Council. The Committee
agreed to waive the requirement for a bond in this case.
FVCC CROSSWALK - Scott Rose, FVCC student, voiced his concern about the
pedestrian crossings at First Avenue East and First Street East and requested
posting of Yield to Pedestrian signs at the corsswalk. He indicated that
large numbers of students use the crosswalk on an hourly basis. DPW Hammer
and Police Chief Stefanie brought up the fact that this problem had been discussed
previously. Several other areas with related problems were brought up. C.
Palmer asked that the minutes relating to this problem be found and a joint meeting
of the Street and Alley and Safety Committees be set to address the problem.
PARKING COMMISSION CONCERNS - Police Chief Stefanie presented a list of
concerns: NORTHWESTERN TELEPHONE PARKING - They had requested a ten minute
parking zone so that customers could run in and pay their bills. This Committee
recommended a 30 minute zone in keeping with other similar areas. There was
discussion concerning the first space adjacent to intersections on First Avenues
East and WEst at 1st, 2nd, 3rd, and 4th Streets. C. Saverud asked about enforce-
ment and was told there had not been many complaints. PARKING LOT RATES -
Commission would like to raise the rates in all lots from $8.00 - $12.00,
except the Methodist Church lot (leave at $8.00) and the Eagles lot (leave
at $20.00). There was discussion of the cost of the various lots, free parking
on the streets and the effect on that, and the problem of long-term abusers.
The Committee felt that these things should be discussed in a joint meeting
of the Street and Alley and Parking Commission. DEPOT PARK AREA - The name
of the street was discussed. It was pointed out that Depot Loop was so named
• by resolution of the Council. The suggestion that half the parking be designated
30 minutes and the other half designated two hour parking was discussed. The
Committee felt this should also be duscussed with the Parking Commission.

VALLEY BANK PARKING LOT - The Bank would like the City to lease the lot.
Attorney Neier needs to write up the lease. ORDINANCE 19A4 exempts the
Central Business District from off-street parking requirements. C. Saverud
said that if that is truly what it ways that it slipped in and was not the
intent of the Council. The Committee asked that Attorney Neier review the
Ordinance and make a recommendation.
DECORATIVE STREET LIGHTS - DPW Hammer explained that the lights
are FOB Austin, prepaid Kalispell, which simply means that Kalispell must
unload and check the shipment at this end. He also explained the breakdown
of costs and available funds: 47 lights X $1,351.10 = $63,501.70
Installation Bid = 23,200.00
Extra Install. (Est.) = 5,000.00
$91,701.70
Tax Increment Available = $87,893.00 There should also be some
Forteited Bond = 6,400.00 monies availale from the
$94,293.00 BN grant for Depot Park
=`- to be used toward the
seven lights for Depot Park.
The size of the bolts and whether they were adequate for cast iron poles
was .discussed. DPW Hammer had asked Dennis Carver to check this out and
also had talked to Bob.Peery -of Antique Street Lamps. Neither saw any problem.
The only problem with the cast iron that Bob Peery has had was with bleeding,
• and that occurred only when painting maintenance is not done about every
5 years as it should be. The Committee approved Antique Street Lamps, Inc.
for the bid subject to review and approval by the City Attorney. DPW Hammer
had some questions about exactly what was included in the installation contract,
especially the difference in weight between cast aluminum and cast iron,
painting, wiring not included from the factory. He was told to make a list
of such questions for Attorney Nei-er to deal with. Time table was discussed.
It was pointed out that the cones were not all up on the bolts and it needed
to be done immediately. (Upon further checking it was found that all the
cones were in place.)
CURB AND GUTTER ON CENTER STREET - DPW Hammer stated his opinion that
it should all be taken out because of the inferior product, depth not correct,
etc. The Surveyor agreed with his position. The quality is just not there.
A reduction in price was discussed, but it was pointed out that is not what
is needed - the quality is important. If compensation, even 100%, was accepted,
it would set a precedent for other contractors, and that would cause all
kinds of problems. The Committee agreed with the concept that the curbing
needed to be taken out and replaced with acceptable work and asked DPW Hammer
to provide documentation of the problems and specifications for quality work
so that the defidiencies could be addressed to the Council at the November
4 meeting.
VALLEY BANK SIDEWALK - The attached memo from Marriott Concrete was
presented by Surveyor Zavodny. C. Palmer asked if they bid for the job.
• The answer was yes. Then he felt they should do it. Surveyor Zavodny pointed
out that the easy and hard jobs tend to balance out over the course of the
contract. DPW Hammer asked to srite Mr. Marriott to inform him of the Committee's
decision.

RE: Sidewalk Replacement - Valley Bank
Valley Bank of Kalispell requested the city concrete contractor,
Marriott Concrete, to install a�w sidewalk and curbing in front of
the main entrance to the bank on 3rd Street West. A quote was given
to Valley Bank by the Public Works Department based on successful bid-
ding by Marriott Concrete.
I have been informed by Marriott Concrete that his excavating
contractor refuses to remove the existing sidewalk at Valley Bank at
the quoted price.
The excavating contractor feels removing the sidewalk at Valley
Bank requires extra measures due to the following conditions:
1. The building overhang which protrudes over the sidewalk
makes it difficult to remove sidewalk in a "normal" manner.
2. The vertical rock pillars on the building appear to be
supported by the sidewalk. Additional precautions would be
required so as not to disturb the pillars.
3. The plate glass windows on the front of the building would
be extremely susceptible to shattering, especially now that
the air is much cooler.
Rich Marriott feels that he is "caught between a rock and a hard
spot." His bid prices were based on quotes from his excavating
contractor. His excavating contractor will do the job strictly on
a time and materials basis only. The time and materials proposal will
without question cost considerably more than the bid prices.
What position does the City of Kalispell take on this matter?
I would appreciate a response in writing, directly to Marriott Concrete.
