• September 5, 1985 STREET AND ALLEY COMMITTEE 4:00 P.M.
Chairman Palmer and Councilmen Nystul and Ruiz in attendance. Mayor Mc-
Dowell, DPW Hammer, Surveyor Zavodny, Butch Wollard from LHC, and Karen Ford
of the Daily Interlake also present.
DEPOT LOOP - Discussion of design, cul de sac, parking, grouping of green
areas for better availability for community use. There was no agreement and
the Committee agreed to take the information to C. Saverud; who was not able
to attend the meeting. After the meeting the Committee went to discuss this
with Mr. Saverud, who agreed with the idea of more green area and less parking.
But the Committee did not come to a consensus on the design, but asked DPW
Hammer to go through the minutes on the closure of the Loop Road to see what
this Committee and the Council agreed on. If the minutes are vague then it
should be presented to the Council again. DPW Hammer also asked to provide
additional site plans with angle parking included to the Committee. The
contractor, LHC, was asked not to begin construction until this is resolved.
EAST WASHINGTON STREET DESIGN - Surveyor Zavodny present the plans for
East Washington, which included eye -appealing merging into the existing curbing
at 3rd Avenue East North, movement of only one utility pole, expansion of the
storm drain system from 1st Avenue East North to 2nd Avenue East North to cover
severe water problems (with the future needs for Oregon Street in mind). The
parking situation behind Little Big Men's was discussed. Widening of Washington
• 21 - 3 feet on that side will cause that to go to angle parking.
PROPOSED PROJECTS AND ESTIMATED COSTS - DPW Hammer asked by the Committee
for a list of proposed projects and the estimated costs.
DECORATIVE STREET LIGHTS - The Committee asked for an update, which was
given by Attorney Neier. Discussion of contract and penalty clause. Attorney
Neier hopes to have time frame information by the 6th. There is no penalty
included in the contract for not finishing on time, but if that occurred the
City would keep the bid bond, which is in cash in our possession. Language
can be added to the contract to that effect. Attorney Neier indicated he is
hoping for a final delivery date of November 30. C. Palmer asked about
"acceptable U.S. Standards" language in the contract because of the fact that
the poles will be made in Mexico. It was pointed out that the primary difference
in casting in the U.S. and Mexico is the set-up cost for molds, which is about
half in Mexico. Attorney Neier needs the base drawing, leveling device, and
a clear shop drawing to be included with the contract. When asked for an explanation
of what had happened up to this point Attorney Neier said that he had sent
the notice to proceed in May. A contract was sent, returned to the City with
changes made by the supplier, Lighting Management. Attorney Neier okayed the
changes and added 13 additional poles to the order, and then returned the contract.
Lighting Management never returned it, and then indicated they did not have
a contract. No explanation was ever received from Lighting Management for
their actions.
DPW HAMMER LETTER CONCERNING TAX INCREMENT FUNDS - The Committee agreed
• that a meeting was needed to determine where, when, and how much was available
for off -site improvements on the Kalispell Mall. DPW Hammer asked to provide
a revised list of component units and their locations on a map. C. Nystul
pointed out that whatever was needed to make the RR crossing at 1st Street
W.N. meet standards should be paid for by BN.

ALLEY BY KALISPELL DRAFTING - C. Nystul gave a report of this situation.
Kalispell Drafting is encroaching on the public right-of-way and this should
be remedied. There appears to be two curb cuts, one of which Kalispell Drafting
has landscaped over, causing the alley to use the one on the next lot. The
owner of this lot objects and is concerned about her liability. DPW Hammer
pointed out that if the Committee chooses to remedy this situation then the
alley must be made a one-way south because of the angle of the original alley
doesnot allow for right hand turns onto Sunset Boulevard. The Committee agreed
to open up the right-of-way to the alley and make the alley one-way south.
This will be on the September 16 Council agenda.
OBSTRUCTION OF SIDEWALKS - The Police Department claims that there is
no clause in the ordinance to include parking on sidewalks, and no fine set
to enforce the ordinance. The Committee agreed that this was a situation for
the Safety Committee and refered it to them.
