Approval of these plans is given herewith and according to the following provisions: That any change in the above referenced plans will be submitted to the Water Quality Bureau for review prior to the beginning of construction, and, That within 90 days after project construction, the engineer shall certify to the department that the project was completed in accordance with the plans and specifications approved by the department. This certification shall be accompanied by a complete set of "as built" drawings signed by the project engineer, and, That departure from any criteria set forth in the approved plans and specifications without department approval is grounds for injunction by the Department of Health and Environmental Sciences. Box 1035 Kalispell, Montana 59901-1035 Re: Prior Approval for Legal and Technical Costs, Kalispell, Montana Dear Mayor McDowell: Region VIII has received the letter of Glen Neier, City Attorney, dated March 6, 1984, requesting prior approval for the legal and technical prosecution costs relating to the City's claim arising from certain • failures which occurred at the City's wastewater treatment plant. The City has applied for a grant amendment which is being processed by the State of Montana and which will include special conditions relating to the use and eligibility of these funds. On December 18, 1983, David Schachterle, Assistant Regional Counsel, by letter, informed Mr. Neier that a grant amendment would be required in order for the legal and technical costs to be eligible. Mr. Schachterle also suggested that the City seek prior approval for these costs pending the execution of the grant amendment. Mr. Joe Steiner, from the Montana Water Quality Bureau has orally informed Mr. Schachterle that the State concurs in the City's request for these legal and technical costs. By this letter, I am approving the request of the City for prior approval of the legal and technical costs related to this litigation. My approval is based on the following: 1. The City has applied for a grant amendment to reflect these costs. The processing and execution of this amendment will take an unknown length of time. 2. The City is under pressure from the Court to prosecute this action and it is very important to act quickly on this request. -61 0 - 2 - 3. The City has had to engage outside counsel and has already incurred certain costs. Any legal and technical costs incurred after the date of this letter will be eligible to the extent a1lo+ved by the grant amendment. Costs incurred prior to this letter will not be allowable. 4. The grant amendment will contain certain special conditions based on the requirements of the Final Part 35 Grant Regulations, 49 Fed. Reg. 6224 et seq., Appendix A, Section A.2.c., and similar to the Attadunents furnished to Mr. Neier in the letter of December 18, 1983. This prior approval will be subject to the same special conditions which will be includedin the grant amendment. It is important for the City to keep EPA, through the Office of Regional Counsel, informed of the status of this lawsuit. The Region believes that this suit is very important and we'will attecmt to al6sist the City by providing legal and technical assistance to the extent possible. M. - April 2, 1984 4 - WATER AND SEWER COMMITTEE "- The Water and Sewer Committee met on this date in the Conference Room at City Hall. Present were Committee members Nystul and Springer, Mayor McDowell, Councilman Grainger, DPW Hammer, Superintendent Hughes, Sandy Fellows and Dennis Carver. North Valley Sewer Line The Superintendent reported that the TV camera will be here next week to inspect the line on First Alley East, from Washington to Nevada street. The inspection will in- dicate if there is any problem with handling the anticipated flow from the sewer district. Sandy Fellows - WoodLand Trailer Court Dennis Carver presented the situation faced by Mrs. Fellows at the trailer court with failing septic systems. The question has been asked about a sewer S.I.D. and what area it might include. The EPA study of the vicinity was also mentioned. There are about 55 landowners in the area that might involve an S.I.D. A discussion mentioned the previous S.r.D.'s failure. Options include a zone change so that fewer septic systems would be required by a different use. A lift station serving just the trailer court vs a system serving a larger area. The committee agreed to assist in whatever option Mrs. Fellows chose. Force Main from North Valley Sewer District Dennis Carver commented on the backfilling of the force main. His opinion was that it was OK. He inspected a couple of times a day. The question was raised about 2,500 feet oflines into the Bitney area that were not signed off by the Engineer- Thomas, Dean & Hoskins. No one knew exactly what the situation was. Other concerns of the force main were: cleanouts - rely on velocity of water; main- tenance of pumps before city assumes; information on pumps; access by vehicle to the wetwell; cleaning the gravity line before it is placed in service.
