The air test for short sewer extensions like this one needs to be revised in accordance with Roy Wells January 6, 1984 memo (copy enclosed) 2. If the manhole is to be cast -in -place, a requirement for waterproofing of the exterior must be included in the specifications. 3. A requirement for inspecting the manholes for watertightness is needed in the specifications. Box 1035 Kalispell, Montana 59901 Re: Federal Sewage Works Grant C300263-01 (Step 1) .Kalispell, Montana Dear Mayor McDowell: Our office has reviewed the Draft Supplement to the 201 Facilities Plan for the Kalispell Vicinity, Volume I prepared by Stahly Engineering and Associates. The report depicts significant limitations to on -site disposal systems in the Evergreen, Woodland Park, and South Kalispell Areas. As the population in these areas grows, the potential public health will increase along with increasing pollutant loads to the shallow aquifer and the local surface waters. The need for improving the existing method of wastewater treatment and disposal is apparent. When preparing the Final Report to Volume I, please consider the following comments: 1. A general statement from the county sanitarian should be included stating the problems, history, and current practices of wastewater treatment for the study area. This letter will further document the need for improved wastewater treatment and disposal. 2. Review Figure 3-10 and consider modifying the figure to eliminate minor discontinuities. 3. On Page 3-35, the depth to groundwater of seven feet is used as a benchmark or limiting criteria and on Page 5-3 the discussion focuses on a depth of eight feet. To establish maximum eligibility for federal funds please include two figures similar to Figures 5-4 and 5-5 based on the 1977 population. We are pleased with the progress on the report and will work with the City, County, Evergreen Water District, and your consulting engineer to complete the entire report as soon as possible. Present at the meeting were Chairman Nystul, Councilman Manning, Palmer and Saverud•, City Attorney Neier, Mr. Grey Lewis, DPW Hammer, Mayor McDowell. Joining at later parts of the meeting were Councilman Grainger, Schindler and Ruiz. City Attorney Neier reported he had contacted three large law firms in the state regarding their interest and ability to assist in the WWTP lawsuits. They did not have any experience in these suits and were not interested in assisting us. He also contacted two other firms, one from Colorado and the Washington D.C. firm of Mr. Lewis. He stated that both firms have experience in these suits but that the firm Mr. Lewis is from was highly recommended. Attorney Neier also stated that EPA in Helena had given verbal approval to use the "contingency" item of the WWTP Construction grant to fund the legal fees. Mr. Gray Lewis of the firm of Lewis, Kominers Sr lames, Washington D.C. then gave information about himself and his firm. He also told about experience in similar litigation and a case they.are presently involved in. Their firm charges a maximum of $100 per hour with an average of $80-85 per hour. He believes this case will not go to trial for at least 9 months and is somewhat concerned about the lateness of getting into it. The questions was asked about additional workload on the city attorney by this litigation. Mr. Lewis stated that they will prepare the drafts of the motions and other documents necessary and that the additional workload will not be too great. Those present seemed to agree to engage Mr. Lewis's firm. Meeting adjourned at 4:10. 4
