Chairmen Palmer and Nystul and Councilmen Springer, Saverud, and Ruiz
present. DPW Hammer, Surveyor Zavodny, Water and Sewer Superintendent Hyde,
Mike Fraser, Jerry Lyford, Ed Kennedy, Dennis Carver, Butch Wollard, and
Roger Hopkins of the Daily Interlake also in attendance.
KALISPELL NEWS AGENCY WATER BILL - This was a request for additional
consideration over the standard 40% adjustment for a leak in the line.
The Committee was in agreement that policy should not be expanded in individual
cases so this request was turned down.
FOUR SEASONS MOTEL SPRINKLING - The owner has requested a sprinkling rate
without installing a sprinkling meter, because the way the plumbing is would
make installation of a sprinkling meter very expensive. The Committee requested
DPW Hammer to inspect the plumbing and report hack.
GRANDVIEW DRIVE EXTENSION OF SERVICES - The parcel in question has sewer
in front of the property (put in by Dr. Roger, LMJ Enterprises, and accepted
by the City). Request is to hook up to existing sanitary and to extend the
water main with a developer's extension agreement. Developer is willing to
sign consent to annex and withdraw from the rural fire district. DPW Hammer
voiced a concern about allowing extension of services under a developer's
extension agreement, and the situation that arises when someone wants to hook
• on to that system but refuses to be annexed. If the City then denies the
hook-up it also denies the developer the opportunity to recoup his expenses.
His concern was that annexation should be written into the agreement up front
so that there is no trouble down the road. C. Springer's opinion was that
the right to any proceeds comes only at the time of hook-up, and the City's
denying hook-up for refusal to annex raises no liability. The extension
agreement needs to go to a joint Sewer and Water and Annexation meeting. Mike
Fraser filled in the Committee on the project plans and the area to be covered.
WQB MEETING - The WQB requested a meeting because they felt the City
was not happy. C. NYstul expalined that the reason was because the City feels
that the WQB based their decisions on inadequate and perhaps faulty data.
The Committee discussed the need for independent data. C. Nystul, DPW Hammer
and Water and Sewer Superintendent Hyde are to meet with Chief Operator Olsen
and report to the Council on October 7.
SAFETY EQUIPMENT - City Surveyor modeled the safety vest and hard hat.
C. Palmer explained the problem and there was discussion of adoption of a
firm policy. It was pointed out that some employees do not want to wear the
equipment. C. Ruiz pointed out that he thought it unnecessary to reiterate
in a meeting a policy we already have. C. Springer suggested that such
employees sign a disclaimer of insurance coverage if they choose not to wear
the safety equipment. The City has a positive obligation to advise employees
and once that is done the City is no longer negligent - once advised and the
employee has signed and it is in his personnel file. Surveyor Zavodny pointed
out that guidelines as to when the equipment was needed would be helpful.
• C. Ruiz said there was no need to bring.this to the Council, it was the super-
visor's job. DPW Hammer will put out a notice to the employees.

CAPITAL IMPROVEMENT PROJECTS FUNDING - C. Palmer summarized the discussion
of the September 30 meeting and DPW Hammer's memo. There was extended discussion
of the use of various funds and options available. The Committee agreed to
take the discussion under advisement until the October 7 Council meeting.
C. Ruiz will get together with the Clerk and have him give existing funds,
timing, and suggestions.
STORM SEWER ON CENTER STREET - DPW Hammer explained with the help of
the chalk board the choice that was open to the Committee: put in the storm
sewer as planned on Center Street, or delete it and use the $150,000 to put
in storm sewer on 5th Avenue West for three blocks and then over to 6th. He
explained that the storm system on Center is not for the Mall needs - they
have their own storm system. The only purpose is to service Center Street.
The Contractor would not lose that portion of the project, it would simply
be shifted to 5th Avenue West. The water could be done at the same time and.
those blocks would then be ready for the opening of Cavanaugh's. The engineer,
Dennis Carver, was of the opinion that deletion of the storm sewer would mean
a 90% job rather than a 100% one, but that the City would be sacrificing very
little. He agreed it was needed more on 5th Avenue West. DPW Hammer said
he had talked with the Sewer Superintendent, Ronnie Anderson, and he said
there were no problems in the area of Center Street. Mike Fraser, the engineer
for 5th Avenue West recommended at least a limited storm system on Center
• because of the grades. There was discussion of the need for having soil logs
and analysis done because of the trouble the contractor has run into on Center.
There was extended discussion of possible modifications for cost savings,
snow removel, expected commercial growth in the area, legal, fiscal and
engineering standpoints, time factors, and other concerns. In the end the
Committee agreed to do the storm sewer system on Center as originally planned.
