09-04-85 S&W Comm MinutesSeptember 4, 1985 SEWER AND WATER COMMITTEE 4:00 P.M. Chairman Nystul and Councilmen Springer and Ruiz in attendance. Mayor McDowell, DPW Hammer, Water and Sewer Superintendent Andy Hyde, Attorney Neier, Paul Stokes and George Mergul from STahly Engineering, Bill Schmidt, and Karen Ford of the Daily Interlake also present. W.W.T.P. - PHOSPHORUS REMOVAL - Primary purpose of the meeting was to determine what needed to be done in response to letter from Scott Anderson which indicated that if the City did not get a plan of action it could lose the 75-25 grant, and also that they were holding up the approval of the Woodland Park until this was taken care of. Discussion of Stably looking at the three alternatives plus the alternative suggested by DPW Hammer. Discussion of past choices, alternatives, changes in the requirements being the cause of this action that must be taken. This step will buy time. If the City does not comply then WQB will not approve the Woodland Park grant. C. Nystul made the point that the City is committed to phosphorus removal, but the remainder of the project which calls for cleaning up Ashley Creek for the fish he has a problem selling to constituents. Finances involved were discussed. WQB is pushing discharge to the Flathead River, and that may be the cheapest alternative. Cost to the City for phosphorus -ammonia removal will be approximately $600,000. Several of the councilmen wondered what would happen if they gave the go-ahead on this so that the WQB would give the approval for the Woodland grant, and then the City didn't do anything. There is the feeling in the council of being blackmailed by the WQB. There was discussion of whether McLaughlin in Denver • needed to be a part of this, based on the fact that they only showed up 4 or 5 times during the building of the sludge handling facility. Paul Stokes indicated they would come whenever requested and he felt they should be included. The Committee moved, seconded and passed approval for Stably Engineering to do the study required by the WQB. This will be on the September 16 Council agenda. The final point of this discussion was that the Committee's aim was for year- round discharge into Ashley Creek. BILL SCHMIDT - COLONIAL VILLA - Mr. Schmidt feels entitled to remuneration from the City for existing services hooking up to the new water line he was required by the City to install for Colonial Villa. The existing lines would be added to the new line so that the existing line could be abandoned. Water and Sewer Superintendent Hyde drew an illustration of how the motel and house affected will be hooked up and what the Water Department needs to do to hook up Mr. Schmidt's new line. Mr. Schmidt feels that the two people involved have not paid hook-up fees and should, as reimbursement to him. A developer's extension agreement does not apply here for water, but would apply for future sewer hook-ups or for future water hook-ups if there is a service area. Mr. Schmidt will submit information for a possible developer's extension agreement for that to Attorney Neier. Mr. Schmidt also asked about an $88.00 bill for raising the main and the Mayor said that he would take care of that. There will, however, be a charge of $92.00 for connection of Mr. Schmidt's extension to the main. WATER RIGHTS ON ASHLEY CREEK - A letter received indicating someone wishing water rights on Ashley Creek was discussed. If the request is upstream of the plant then the Water and Sewer Superintendent is to respond that the City • is against it. ajg -
