WATER & SEWER COMMITTEE
The Water & Sewer Committee met Monday, March 19, 1984 in the Conference Room at City
Hall at 4:20 P.M. Present were committee members Nystul, Springer and Ruiz, Council-
man Schindler, Mayor McDowell, Water Supt. Hughes and Sim Fleming and Bill Vann from
Equity Supply.
1. As requested by the Superintendent, Mr. Fleming and Mr. Vann were present to dis-
cuss the water metering at Equity Supply. Equity Supply has a water well at the
creamery. It produces 50 gpm and is used as the primary source. City water, in
effect, supplements their wellwhen required. The well is not metered and since
we have a sewer charge based on consumption, the question of their bill computa-
tion has again arisen.
It was stated by Equity that the well is limited to 50 gpm and that there is an
hour meter on the pump which can be read. The well averages about 260,000 gal-
lons per month. Equity states that their usage is as follows: 18.5% to product
(ice cream, rolling mill,etc.); 68 washing trucks; 32..5% boiler make up water;
43% clean up.
At present, all Equity water meters have the usual application of sewer rate.
One additional bill of $326.12/month on account 36-101 hS the estimate for the
sewer usage caused by the well. Equity estimates that 43% of their water enters
the sewer.
It was agreed that the city would study the Equity figures and if necessary,
would meet again. --
•2. Some time ago proposals were received in reply to our RFP on a storm water study
for the area north of HWY #2 and west of Meridian Road. The RFP was a brief de-
scription. It was agreed that the Supt. would take the information presented in
the several responses and write a complete RFP so that accurate engineering costs
could be obtained.
3. The previously considered storm sewer on 6th Avenue W. and loth Street was presented.
The project primarily addresses a storm line crossing private lots. We do have an
"easement". The project would also be extended to remove the storm inlets at 5th
Avenue W. and llth, which now drain into the sanitary. It was decided that this
project should be submitted to see how it fits into the 5 year street plan.
4. Estimates to repair the golf course water line were based on 2,200 feet of pipe.
The Fire Department has determined that the existing fire hydrant is essentially
useless for a major fire. Councilman Ruiz stated the Golf Association would meet
this week and he would present a cost sharing program to them. One proposal is
that the Golf Association dig the trench, the city pay for and install the pipe,
bed the pipe and the Golf Association back fill and restore the surface. The com-
mittee will recommend to the Council that the committee be authorized to negotiate
a cost sharing with the Golf Association to run a line from the high pressure
district.

6. A letter was received by the DPW from Jay Billmayer, Engineer for the Green
Acres Sewer, relative to their recent bill. Due to the hour, there was not
time to discuss it. It will be on the agenda for the next meeting.

The above referenced plans and specifications have been reviewed by engineers
of the Environmental Sciences Division and were found to be satisfactory.
Approval of these plans is given herewith and according to the following
provisions:
That any change in the above referenced plans will be submitted to the Water
Quality Bureau for review prior to the beginning of construction, and,
That within 90 days after project construction, the engineer shall certify to
the department that the project was completed in accordance with the plans and
specifications approved by the department. This certification shall be
accompanied by a complete set of "as built" drawings signed by the project
engineer, and,
That departure from any criteria set forth in the approved plans and
specifications without department approval is grounds for injunction by the
Department of Health and Environmental Sciences.

Dear Mayor McDowell:
Region VIII has received the letter of Glen Neier, City Attorney,
dated March 6, 19M, requesting prior approval for the legal and technical
prosecution costs relating to the City's claim arising from certain
. failures which occurred at the City's wastewater treatment plant. The
City has applied for a grant amendment which is being processed by the
State of Montana and which will include special conditions relating to
the use and eligibility of these funds.
On December 18, 1983, David Schachterle, Assistant Regional Counsel,
by letter, informed Mr. Neier that a grant amendment would be required in
order for the legal and technical costs to be eligible. Mr. Schachterle
also suggested that the City seek prior approval for these costs pending
the execution of the grant amendment. Mr. Joe Steiner, from the Montana
water Quality Bureau has orally informed Mr. Schachterle that the State
concurs in the City's request for these legal and technical costs.
By this letter, I am approving the request of the City for prior
approval of the legal and technical costs related to this litigation. My
approval is based on the following:
1. The City has applied for a grant amendment to reflect these
costs. Tine processing and execution of this amendment will take
an unknown length of time.
2. The City is under .pressure from the Court to prosecute this
action and it is very important to act quickly on this request.

3. The City has had to engage outside counsel and has already
incurred certain costs. Any legal and technical costs incurred
after the date of this letter will be eligible to the extent
allowed by the grant amendment. Costs incurred prior to this
letter will not be allowable.
4. The grant amendment will contain certain special conditions
based on the requirements of the Final Part 35 Grant Regulations,
49 Fed. Reg. 6224 et �., Appendix A, Section A.2.c., and
similar to the Attachments furnished to Mr. Neier in the letter
of. December 18, 1983. This prior approval will be subject to
the same special conditions which will be included in the grant
amendment.
It is important for the City to keep EPA, through the office of
Regional Counsel, infonned of the status of this lawsuit. The Region
believes that this suit is very important and we'will attempt to assist
the City by providing legal and technical assistance to the extent possible.
