PARKS/PUBLIC LANDS/ANNEXATION/BUILDING REGULATION COMMITTEE MEETING
• May 25, 1989 4:00 P.M.
Present at the meeting were Councilmen Furlong and Atkinson, City
Attorney Neier, Building Official Kerzman, City Surveyor Fred Zavodny,
and David Greer.
Committee Chairman Furlong called the meeting to order and explained
the procedure that would be followed for each property annexation,
and the order they would be in.
Pat Ramsey asked if the committee had made up their mind already
whether they are going to annex or not, or will any input that the
people have today have any effect. C. Furlong said the committee
will make up their mind and vote after going through all 17 annexations.
Mrs. Ramsey asked if they would still be annexed even if the majority
was against it as stated in the Notice? C. Furlong stated that is a
state law regarding wholly surrounded areas.
1. Buckallew Addition. Residential, R-3 zoning. C. Furlong read
the names of all the property owners, which he did for each annexation.
Don Buckallew spoke against this annexation. C. Atkinson asked for
input from the citizens for or against the zoning and their concerns
with it.
2. County Addition. Public, P-1 zoning. No comments.
3. Dry Bridge. Residential, R-2 zoning. Fred Kluesner asked how
much they were going to be charged for the services that may not be
available at this time, such as street lighting, curbs and gutters,
storm drains and sewer? Fred Zavodny said no one would be assessed
for lights unless the City in conjunction with PP&L puts lights in.
He said there is no curb assessment there now but there could be at
some point in time if an SID is created to improve the streets.
Every property in the city pays a storm drainage fee based on the
size of their property and what is contained on the property. The
only way they will pay a sewer assessment is if they are on the city
sanitary sewer. Mr. Kluesner asked what was the city's anticipation
of getting sewer to those lots? Fred said it would be the same as
any other properties in the city without sewer, as septic tanks fail
or as people request it. There was a discussion on where Kluesner's
sewer would come in. Mr. Kluesner said he didn't think his property
is wholly surrounded because the south end of Woodland Avenue is in
the county and has never been deeded to the City, and therefore he
is not totally encompassed by the City. City Attorney Neier explained
the Attorney General's opinion regarding wholly surrounded property.
Mr. Kluesner stated he is totally opposed to the annexation.
4. Eighteenth Street. General Business, B-2. C. A. Neier stated
the property out there is used for industrial purposes, but he
didn't think we could give it an Industrial, I-1 zoning classification
10 because it would not be in conformance with the Master Plan, and by
no
• law we can't annex or zone in contravention of the Master Plan. C.
Furlong stated there were two avenues the property owners could use,
1) they could be grandfathered in with their current usage regardless
of the B-2 zoning, 2) they could go through the procedure for changing
the Master Plan.
5. Eighth Street Addition. Residential Apartment, RA-1. No comment.
Anthony Lupo asked the committee to explain what the zoning classifi-
cations mean, which was done.
6. Grandview Addition. Residential, R-3. No comment.
7. Heritage Addition. Residential Apartment, RA-1. No comment.
8. Indian Addition. Residential, R-3. No comment.
9. Meridian Tracts Addition. Residential, R-3. Fred Wallner
stated he is opposed to the R-3 zoning, he feels it should be zoned
Commercial as there are so many businesses in that area. David
Greer stated the Master Plan shows that area as Urban Residential
and FRDO had advised the owners in that area to pursue an amendment
to the Master Plan and do a neighborhood plan for that area.
James McKinley agreed with Mr. Wallner. He stated the taxes now are
very high and his income per year is only about $10,000. David
Greer explained that he could go to the County Appraiser and use
residential zoning as a basis for getting a reduction in taxes. He
also said if a resident makes less than $10,800 annually you qualify
for a substantial reduction in taxes.
Harley Gosney asked about the letter sent out by the City regarding
the zoning, he said he never received a letter. C. Furlong said the
City is not trying to do anything behind his back.
10. North Meridian Addition. Residential Apartment, RA-1. Melody
Gower stated they have a welding business and repair shop on their
property now and it is zoned General Business, she said the proposed
zone does not make sense. David Greer said according to the Master
Plan it is zoned residential. Mrs. Gower said she thought it should
be judged by the majority of land use there, which is commercial.
Mr. Wallner asked why the Meridian Road area is broken down into so
many tracts, it should all be one zoning area. David Greer explained
that it is viewed in different segments by the Master Plan.
Mr. Gosney spoke in opposition to being annexed.
11. Northwest Tracts Addition. Residential, R-3. Bob LeDuc inquired
what the City is going to do within the next 5 years regarding
services. C. Furlong stated lights will be put in either at the
• request of the property owner, by creating an SID, or by the City of

• Kalispell. Streets would become part of the Kalispell street system
immediately upon annexation. C. A. Neier said FRDO prepared and the
City Council adopted an Extension of Services Plan in March and a
mini -extension of services plan for each annexation. Mr. LeDuc
asked when the taxes start, C. A. Neier said the first payment would
be in November of 1990. Mr. LeDuc said he is still opposed to being
annexed into the City.
John wells spoke regarding the problem of getting a sand truck on
North Meridian Road in the winter, that road is very treacherous.
He spoke against the zoning, he thought it should be commercial. C.
A. Neier said this property is the same as the Eighteenth Street
Addition, an Industrial, I-1 zoning classification would be in contra-
vention to the Master Plan.
Pat Ramsey spoke in favor of being zoned commercial also. She
inquired about the water runoff problem in the spring, what would
the City do about that? C. Furlong said it would have to be
addressed and would be taken care of in time.
12. Salish Court Addition. Residential, R-3. No comment.
13. Slivers Addition. Residential, R-2. No comment.
14. Sunnyview Addition. Residential Apartment, RA-1. No comment.
• 15. Third Avenue Addition. Residential Apartment, RA-1. Anthony
Lupo spoke in opposition to the zoning. He felt it should be zoned
the same as businesses. He inquired why there is now such an urgent
need to annex all these parcels? David Greer explained that every
year the Planning Board adopts work programs for the coming year,
and this was on that work program.
Ardith Gendreau spoke in favor of the Residential, RA-1 zoning.
Edythe Hill spoke in favor of the RA-1 zoning also but is opposed to
the annexation. She inquired if she would be notified by letter if
someone requested a zone change, David Greer said any property owner
within 150' would be notified. Mrs. Hill asked several questions
about connecting to the sewer and the water/sewer rates.
Mr. Lupo asked if it was possible to zone half of the property RA-1
and half business? David Greer said it could be split.
Mabel Ryker spoke in favor of the zoning. She asked if the one
sewer lift there would be enough. Fred stated that would be enough.
Mrs. Gendreau asked if they would be taxed for storm drains when
they were annexed even if they don't have them. C. A. Neier said
they would.
• Mrs. Hill asked about hooking up to the sewer main. There was a
discussion on this.

Harold Quande asked what the City charges for hooking up to the
sewer line. C. Furlong said $500. Fred said he would have to hire
a private contractor to hook up from the main sewer line to his
house.
Mrs. Hill asked if the water line is not adequate, would she have to
bear the cost of putting in a new water line. Fred said he could
not answer that at this time.
16. Two Mile Addition. Residential Apartment, RA-1 & Neighborhood
Business, B-1 zoning. Gladys Millhouse spoke in favor of the B-1
zoning.
17. Wyoming Addition. Neighborhood Business, B-1 & Residential,
R-4 zoning. Roscoe Lewis stated the property on the north end of
6th Avenue belongs to the County, so that does not make their area
an island and they should not be annexed to the City. He spoke in
opposition to the annexation.
Clem Wisher spoke against the Residential, R-4. Greer said Wisher
would be grandfathered because of his business.
Nadine & Bill Fincher spoke against the R-4 zoning.
C. Furlong thanked the people for their input and explained the
procedure to be followed next for recommending the annexation zonings
to the Council.
Buckallew Addition. MOTION: C. Atkinson moved that this committee
recommend to the City Council the passage of the annexation of the
Buckallew Addition with R-3 zoning classification. C. Furlong seconded.
Motion passed unanimously.
The same procedure was followed for the 16 other annexations and
proposed zoning classifications and all were passed unanimously.
