March 16, 1989

Present at the meeting were Councilmen Furlong, Nystul, Mayor Kennedy,
City Attorney Neier, Surveyor Zavodny, Building Official Kerzman,
Parks Director Baker, David Greer, and Dick Koch.
GOLF FEES
Chairman Furlong called the meeting to order and turned it over to
Dick Koch from the KGA. Dick explained that the KGA is contemplating
a major irrigation expansion this year which they are in the process
of funding now. He stated the first payment would be due sometime
in the spring of 1990 and they are expecting a 15-year amortization
of that debt and a contract payment of approximately $65,000 -
$75,000 per year. He said the plan is to increase the daily annual
greens fee of $1.00 for the 18 hole championship golf course and
$1.00 for the 9 hole golf course. The golf cart fee will also be
raised $1.00.
C. Nystul asked what the cost of the sprinkler system will be. Koch
said a round figure of $500,000.
MOTION: C. Nystul moved the committee recommend the Council concur
the fees as presented. C. Furlong seconded. Upon a vote the motion
passed unanimously.
01 Extension of Services
David Greer reported that the Public Works Department and other City
departments had reviewed the latest draft of the Extension of Services
Plan. He said Chapter 5 of the Plan was one of the most important
chapters, dealing with policies of the City for annexation, such as
under what conditions will they extend services and who's going to
pay for them. Greer said the staff would probably be satisfied with
the Plan by the end of the week, with some amendments,. so they could
probably have a Council version ready by Monday or Tuesday.
Greer reported they had prepared mini -plans for each one of the
proposed islands, speaking to existing services, anticipated service
needs, extension of planning strategies, and a map of the area. He
said this was also going through the final review stage and could
probably have them available next week as well.
Greer presented a schedule for the annexation process. He said
there are two processes going on at the same time --annexation and
zoning. He went down the schedule and explained what needed to be
done on what dates. He said the Council should act on the Extension
of Services Plan around April 1st as it has to be in place before
they can pass the Resolution of Intent. He said the Planning Board
would hold 17 public hearings so that each island is considered on
its own merits. The recommendation would then be made to the Council
• on appropriate zoning and on April 17 the Council would pass a
Resolution of intent, one on each island, then immediately following
that the landowners must be notified by letter and also two newspaper
notices must be published (April 26 and May 3). Then on May 15 the
City Council would hold a Public Hearing just on the zoning and on
June 5 there would be final Resolutions of Annexation on the islands
and the zoning would be part of that.
Greer said the public could protest the annexations; they could
protest the zoning but the Council by a 3/4 majority vote can override
the protest.
There was a discussion regarding the property owners, if they are
aware what's going on. Greer said they had had several inquiries
and most of them were for it.
Zavodny commented that they hadn't addressed roadways. City Attorney
Neier advised they could be annexed by petiti.ton at a later time.
There was a discussion of the condition of some of the roads.
C. Furlong asked what kind of cost is involved immediately in this
extension of services. Greer stated there is nothing in there that
says the City will immediately spend any money on any of these
islands.
Greer stated they do identify problems such as water lines. He said
there is language explaining extension of sewer could be sought
• through a grant program or an SID program.
C. Nystul asked about the section regarding garbage, stating "The
City will not provide solid waste disposal. for 5 years". He asked
if the City could not do that even if the owner wanted them to?
Zavodny said under no circumstances. Neier said that was to protect
the MRC.
C. Nystul asked when the islands would go on the tax rolls. Greer
said December 31st.
There was a discussion of when the documents would be ready for the
Council. C. Furlonq_ stated he would be out of town from next
Tuesday until April 2 so he would like to have copies by Monday.
C. Nystul asked how the City would get the warehouses on 7th Avenue
West North south of Kalispell Lumber annexed? Greer said they would
have to voluntarily request to be annexed.
Zavodny asked if the City annexed something that should not have
been annexed, how long does that person have to protest? City
Attorney Neier said he thought it was seven years.
