PARKS/PUBLIC LANDS/ANNEXATION/BUILDING REGULATION COMMITTEE MEETING
April 3, 1989
9:30 A.M.
Present at the meeting were Councilmen Furlong, Atkinson, Nystul;
Building Official Kerzman, and David Greer.
Chairman Furlong opened the meeting and turned it over to David
Greer. Greer stated that in the previous draft of the Extension of
Services Plan they didn't address three slivers of land, so they
added a page to the plan, calling these additions the "Slivers
Addition" and "Indian Addition". He presented the updated version
of the plan. Greer also mentioned that when they got the title
report back it showed that one of the islands which had been annexed
in 1979 had been de -annexed in 1984, but the ordinance (Ordinance
No. 1025) de -annexing it had never been filed. There was a discussion
regarding how to handle this. C. Furlong requested a legal opinion
from City Attorney Neier.
MOTION: C. Atkinson moved that the committee recommend to the
Council the passage of a resolution accepting the City of Kalispell
Extension of Services Plan. C. Nystul seconded. After a short
discussion the motion was voted on and passed unanimously.
C. Furlong stated the Mayor and Parks Committee had received a
letter from the KGA stating they will have a report for the 2nd
council meeting in May regarding the negotiations between the Friends
of Lawrence Park, KGA and Chamber of Commerce -
David Greer stated that on April 17 the Council should be prepared
to adopt the 16 resolutions of intent for annexing the islands. C.
Furlong requested Greer to coordinate this with the City Attorney.
C. Furlong stated he would be absent from the state April 5 - 17 but
will be at the meeting on the 17th. He requested the Committee keep
in touch with FRDO during his absence so that the guidelines for the
annexations are met.
C. Furlong asked Building Official Kerzman about the Lence situation.
Kerzman stated it would go before the Board of Appeals on April 6.
The committee felt that the historical perspective of this situation
is extremely important and should be brought out at the hearing,
including all correspondence.
C. Nystul stated he would be absent from the state April 22 to May
10.
