02-09-89 Parks Comm Minutesri PARKS/PUBLIC LANDS/ANNEXATION/BUILDING REGULATION COMMITTEE MEETING iFebruary 9, 1989 4:00 P.M. Present at the meeting were Councilmen Furlong (Chairman), Atkinson, Gunnerson, Nystul; Mayor Kennedy, Parks Director Baker, Building Official Kerzman, Surveyor Zavodny, and David Greer. ANNEXATION UPDATE: David Greer explained that what FRDO has to do now in regard to annexation of wholly surrounded lands is to have an Extension of Services Plan, which was last adopted in 1984 and does not specifically address the 17 islands, so there are two things they need to do: 1) Write a mini -Extension of Services Plan for each one of the islands regarding what city services will or will not be provided to each of those islands upon annexation, and augment this larger Extension of Services Plan with those 17 mini -plans. 2) They will also have to amend the 1984 document to bring it up to date. He stated that we could not proceed with the annexation of those islands until the contents of the Extension of Services Plan is agreed upon. He said they already had drafts of the mini -plans done and the Public Works Dept. has reviewed them. Greer said the Council would have to approve the plan before we ever notify the public that we're going to pass a Resolution of Intent for annexing of the islands. He said that State law says we have to address certain services and the plans will address each of these services. There was a discussion of what all services and costs are involved. Greer exolained the time line on this. He said he honed the Planning Board could hold the zoning public hearing April 11, the recommendation goes to the City Council, then a Resolution of Intent by the City Council on April 17th, written 40 notification of landowners on April 24, newspaper notices on April 26 and May 3, and a public hearing on the zoning by the Council on May 15. At the very next meeting following the 20-day protest period the Resolution of Annexation has to be done which is on June 5. He said if we can get the plan done within a month we can follow these dates. FRDO will do the documents and the Council will review them and 'hopefully adopt them. There was a short discussion on the Old Highway 93 South and if it would be involved in the annexation, and it is not. Surveyor Zavodny stated that it stands alone and could be annexed at any time. MOTION: C. Nvstul moved that the committee direct whatever action has to be taken to bring it to the Council for annexation. C. Atkinson seconded. Motion passed unanimously. HORSES IN THE FAIRGROUNDS. C. Nystul reported that he had gotten complaints from citizens regarding the odor, dust, noise, and foul language at all hours of the day. C. Furlong asked if we have any control over what goes on at the County Fairgrounds. C. Nystul said the area where the complaints are coming from is in the city limits. C. Furlong proposed that C. Nystul to research this and come back with a recommended action. OLD GRIFFIN FIELD PROPOSAL. C. Nystul discussed the 100-unit senior citizen project proposal for old Griffin Field. He said he had talked with FRDO to see if anyone had asked their opinion of the project and no one has. Nystul said that r Steve said there would have to be a zone change. He said his recommendation is to ask the FRDO staff to give us their evaluation of the zoning and the impact in • overall land use that such a plan would have over there. The Mayor authorized the committee to do so. HIGHWAY 93 NORTH & SOUTH RECONSTRUCTION C. Nystul stated he thought the Mayor should ask FRDO to advise us about planning considerations that should be expressed to the Department of Highways over the design of Highways 93 North & South Projects. Greer said the Dept. of Highways is hiring a consultant to work with the Planning Board to study all approach permits from Idaho to Reserve, so we will have some input, but he. felt that we should have some formal input to the decision making process and that the Council is at least interested in it. The Mayor so ordered. WOODLAND PARK DEVELOPMENT UPDATE Mike Baker stated that the main contributor to the amphitheater project had withdrawn his contribution and they are seeking other avenues for funding. He stated the Jazz Society and some members of the Flathead Festival of the Arts are looking for ways to raise funds. There was a discussion of what facilities had been addressed, such as sewer and water, parking, etc. LAWRENCE PARK UPDATE There was a brief discussion regarding the KGA proposal for adding nine more holes in the bottom land. It was put on hold until we receive a report from the KGA. Mike Baker reported that he had attended a sub -committee hearing in Helena on Tuesday regarding the Reclamation Grant for the stabilization and re -vegetation of the hillside of the gravel pit at Lawrence Park. He said we were number 17 on a list of 35 as far as funding goes. He said that he had talked with a Bureau Chief, Carol Lee, who said the committees are asking the recipients of the grants to go back and try to generate more revenue within their application process, and the amount we need to contribute is $2,000 - $4,000. He said there is an Executive Committee meeting next Wednesday that Ms. Lee would be willing to go to and say that the City of Kalispell would contribute so many dollars. He said we would only be obligated to contribute if the grant was given to us. Baker said he had talked with the KGA and they felt very comfortable with committing themselves on a 50/50 split with the City. MOTION: Atkinson moved that the committee give Mike Baker the authorization to go ahead and commit ourselves to $1500-$2000 so we can assist ourselves in the grant application. Gunnerson seconded. The motion passed unanimously. HERITAGE PLACE SUBDIVISION David Greer explained what the subdivision included. He said there would be a convalescent home with an 80-unit extended care facility and 20-bed personal care unit. He said the annexation is now pending before the Kalispell City -County Planning Board which will hold a meeting and public hearing on the zoning next week. That recommendation will be sent to the Council. He said it has to be approved by the Council within 35 days, of which 10 have already passed, so the Council would have to act on it at the Council Meeting March 6th, which is 25 days from now.
