• Chairman Hafferman and Councilmen Manning and Grainger present. DPW
Hammer, Attorney Neier, Surveyor Zavodny, Building Official Jackson, W/S
Superintendent Hyde and Nick Verma from FRIO also in attendance.
JONES ZONING ORDINANCE AMENDMENT - The Committee recommended approval.
BUFFALO HEAD TOWNHOUSES - W/S Supt. Hyde indicated that the Developer
has added the language requested by the City to the plat and also the easement
giving the City access has been added to the plat. There was some discussion
of timing of the City's approval. State approval has not come back yet.
It was agreed that the Committee would recommend approval of the final plat
but would not turn on the water until State approval is received. Attorney
Neier pointed out that in 6 months the preliminary plat for all of Buffalo
Head ceases.
KALISPELL MOTEL - The fire hydrant problem has been solved by redesign
of the road and hydrant situation. DPW Hammer said the site plan was approved
but the developer has not complied. The Committee asked Attorney Neier to
draw up a Resolution of Intent to Annex. The fee will be waived and he
City will cover the cost of legal notices. OR
SCOTTY'S BAR ADDITION - Public hearing and first reading of ordinance
will be March 3. The Committee recommended approval. S/W Supt. Hyde indicated
that the City can provide fire protection within the next 12 months. This
• also means that the City can pursue annexation of BMB. Attorney Neier is
to set the public hearing date and prepare the ordinance for BMB Addition.
HOUSE BILL 791 - Attorney Neier is to research how Lincoln County has
handled this.
COMPREHENSIVE PLAN - This was tabled until the next Council work session.
CHANGE OF ZONING CLASSIFICATIONS - The Committee asked Mr. Verma to
provide information on this topic for the next Coucnil work session.
ORDINANCE TO ADOPT 1985 BUILDING CODES - Building Official Jackson explained
that the only difference from the 1982 Codes is the proposal to leave the
fees -at the 1982 level because an increase would cause resistance and for
the last three years there has been an excess of funds brought in by the
department over what they have used. This excess goes into the general fund.
He said there is an increase in plumbing permit fees and the department will
begin issuing mechanical permits.
Mr. Verma asked for a standard procedure for approaches to annexation.
There is a need for criteria differentiating between the use of an ordinance
or a resolution to be included in the policy manual.
