Chairman Manning and Councilmen Springer and Nystul in attendance.
Austin Miller and Roger Hopkins of the Dialy Interlake also present.
This meeting was held at the request,of Austin Miller to discuss the
ANNEXATION AND SUBDIVISION OF THOMPSON'S SUMMIT RIDGE NO. #175.
The concern of Mr. Miller and the neighborhood is that allowing this
parcel to be divided into three lots makes the lot size too small to be com-
patible, with the surrounding lots. This will in turn cause the property
values of the surrounding lots to drop because the size of the homes would
be considerably smaller than other neighborhood homes. Mr. Miller asked if
the City had the right to destroy property values by allowing three lots.
Mr. Miller gave a history of this parcel: It was not included in the
original subdivision because it was included in a buy -sell for a different
parcel. In the end it was not included. Finally was sold to Mr. Barkus for
him to build a 4,000 sq. ft. house on one level. He changed his mind because
he thought that smaller houses would destroy his property value.
Mr. Miller indicated that he and the neighbors, whom he feels duty bound
to protect, have no objection to this parcel being divided into 2 lots. City
Attorney Neier indicated that Barkus and Thompson have complied with all the
technical points and feels the problem is between Mr. Miller and the present
owner, and would advise Council as such. No legal basis is available to deny
• the subdivision when annexed, and there is none now to withdraw it.
Mr. Miller indicated that he would sue to protect the people. There
are no covenants on that parcel and it is conceivable that they could put
in double -wide moblie homes or Boise Cascade homes. Covenants were not added
when land was sold to Barkus because he was to build one house.
.The Committee strongly recommended to Mr. Miller that he should have
a meeting with Mr. Barkus to suggest changing it to two lots. The City cannot
be officially involved.
The question was posed: Does the City Council havethe right to reduce
surrounding property values by annexing VS Do we have an obligation to protect
your property?
City Attorney has asked the Building Department to give him an opportunity
to see the building permit before issuing the permit. Committee will request
that Council take no action until there is a meeting and/or agreement between
parties.
Evidently Thompson is not adverse to the possibility of adopting covenants -
has a question on only a couple of them.
City Attorney will try to set up a meeting with Austin Miller and council,
himself, and Barkus and Thompson and invited council - but the impetus for
. solving this must come from Austin Miller.
