ANNEXATION COMMITTEE
The committee met in the Conference Room. Present were Chairman Manning, Committee mem-
bers Palmer and Springer, Mayor McDowell, City Attorney Neier, DPW Hammer, Fire Chief
• Doty, Building Official Petersen, Attorney Dan Johns, Dean Marquardt, Don Barringer and
Surveyor Zavodny.
UMI
C. Manning reported a problem with regard to services. Engineer Jay Billmayer will get
engineering drawings for sewer and water services. A public hearing will be scheduled
after DPW Hammer and City Attorney Neier coordinate whatever needs to be done.
Kalispell Motel Property
S. Zavodny reported the unusual situation of the motel being located half in the city
and half in the county. Jurisdictional problems result with the city being called for
some of the rooms, the county for others, when there is a need for law enforcement.
Fire protection also poses a problem. Sewage and water are provided by the city. A
portion of Highway #2 was annexed to straighten out an angle in the property.
DPW, Building Official and Surveyor will get together on a drawing to designate what
exactly is city, what is county. Will act on their findings at the next committee
meeting.
Dorothy Breck Property
C. A. Neier reports that we have not received anything from the county on this.
Wholly Surrounded Land
C. A. Neier will be working on getting information regarding notifications, etc.
Monk Addition
• The first reading is scheduled for October 15 Council Meeting.
Amfac Building Request
C. Manning stated that he, C. A. Neier, Attorney Johns and FRDO Verma met to discuss Amfac
site annexation. .Property has 2 zoning classifications, B-3 and RA-1, Intended use is
compatible with current zoning which complies with County zoning on the east 300' which
is where the building will sit. The west 300', zoned RA-1, will be for storage, no struc-
ture on that portion. Filing will go through FRDO.
DPW reports that the developer plans on subdividing width -wise. Plans would allow for
future street on the back side of property. The entire tract isn't coming in, every-
thing but 1471' x 600' deep.
Atty Johns showed a map, the survey is being done to 1 tract, developers prefer to
connect to city services and request annexation.
C. Palmer's concern is the request states that if not conforming or any other problem,
they reserve the right to withdraw from annexation process. C. A. Neier said that
everything conforms.
C. Manning could see no problem, suggested that maybe Attorney Johns needs assurance
that DPW Department will get services in prior to laying asphalt.
C. Palmer moved that recommendation to Council, will be to get Waiver of Right to
give services with the agreement that they file and pursue the annexation. 2nd by C.
Springer. All voted aye. Motion carried.
•Discussion of storm drain concern. DPW Hammer stated that the storm drain study is
almost finished. The storm drain ditch can handle only a certain amount of develop-
