05-30-84 Annexation Committee4:00 P. M. May 30, 1984 ANNEXATION C0tM9ITTEE The committee met on this date in the Conference Room at City Hall. Present were Chair- man Manning, Committee Member Palmer, Councilman Saverud, DPW Hammer, City Attorney Neier, Water Supt. Hughes, Surveyor Zavodny and Building Official Petersen. Extension of Services C. Manning stated that there were some problems with the recommended policies and the question must be addressed as to whether or not properties should be annexed for ser- vices. According to the policy adopted this year, if services are extended without annexation, the developer has to go through waiver of protest and criteria prior to services being extended. C. Palmer stated that there is no way of knowing if waiver of rights is signed. All agreed that a recorded document is needed. Palmer said that S.I.D.S's are also a problem. The County gives notice of what properties are on S.I.D.'s, the City does not; he sug- gests that the City record this information. C. A. Neier will check with other cities on these items before the June 13 Council meeting. C. Manning said that presently we are looking at extension of services on a case by case basis. He does not like to do that, would like to say if contiguous, the property will be annexed and services will be provided _if not contiguous, to extend the waiver of protest. C. Palmer stated that the ideal example of waiver problems is the Marquardt development. out of the 95 involved in this development only 5 have signed the waiver. He suggests that a clause be included in the policy that the total subdivison be involved. The • developer and not the user must sign. It is hoped to have philosophy of service extension to present to Council on June 13. Heritaqe Health Center C. Manning stated that there are some misconceptions on this. It has not been filed but has gone through the second reading; the developer wants a conditional use permit. Bldg. Official Petersen stated that he was not aware of the problem, but it is on schedule for the June 13 Board of Adjustment meeting. He will notify the BOA in writing prior to that meeting that they will not be able to review the development until it is properly filed. Manning further stated that we must have some in-house process to police this type of happening. Surveyor suggests that second readings not occur until after the plat is signed and ready to file. One staff member should be responsible for a check list. This development does not have COS of either of the two tracts, or even an assessor's tract number. We should take a more stringent look at what our authority is regarding intent to annex. Our condition should be that everything must be in order at resolution of intent, if not, the process will not be started until it is. Discussion followed of developers request to change temporary cul de sac and public right-of-way. They must address the need for turning around radius of 50' that has to be kept open and not interfere with or reduce parking area. We will require a tempor- ary easement until such time as the cul de sac is removed. C. A. Neier suggests that Building Official Petersen inform the developer in writing that a filed plat is required for both parcels, then it has to come back to DPW Hammer • for review. -1- } Annexation Committee Meeting Page 2 May 31, 1984 Meridian Road Zoning C. Manning announced that this issue was being brought back via committee to go to Coun- cil--- then to Zoning Committee who will return it for Council action. It is hoped for 2/3 approval at least at the June 4 meeting. C. A. Neier will check to make sure this is being properly done. The proposal of the Zoning Commission includes a change of zone classification at an alley. Against Meridian the area would be B3; light indust- rial on the north side and lots 1-2-3 of Block 1, Lots 4-16; Lots 4-5-6 and 13-14-15 of Block 2, and remaining areas residential. Non conforming permits, possibility of recommending change in the Comprehensive Plan, and the Council meeting as a whole to decide what they are willing to compromise were discussed. Also, the impact on street traffic if zoned industrial. A recommendation is needed from the Council for the Zoning Committee of June 13th. Heller Property C. Manning has received a request for a zone change from R-4 to B-2 (neighborhood busi- ness). The last identical request was in 1982, there are signed petitions from that era. A fence has been built on the north side, otherwise the property hasn't changed significantly in nature or in intended use. City Attorney Neier will write an opinion on this, indicating that the request is not being considered. Northwest Horizons • A brief discussion indicated that this is the same situation as Heritage Health Care Center. Problems such as the water line being 1' out of easement: 60' with a 12" water main would resolve. An emergency turnaround at one end of Buffalo Hill Drive was discussed. Surveyor Zavodny will meet with City Attorney Neier and DPW Hammer on Thursday morning at 8:30 for further discussion of this. Meeting adjourned at 5:20. ms 0
