04-19-84 Annexation CommitteeAnnexation Committee Page 2 April 19, 1964 N10TION: Councilman Palmer moved to adopt this request with the recommendation that lighting be addressed in specifically this one and it will also be considered in all future annexations. Seconded by C. Springer. All voted aye. Review P.U.U. - - The final draft is done on PUD, this went back to committee twoCouncilmeetings ago and all concerns have been addressed at the last committee meeting. MOTION: C. Springer moved that the committee recommend to the Council the policy be adopted that members accept the opportunity to review issues, but if they do not avail themselves of this opportunity, they will accept the recommendation of the committee. Second by C. Palmer, all voted aye. Zoning on Meridian Addition: At the last Zoning meeting the recommendation was for B-3 Business; this area is all residential under the Master Plan. Storm Addition threatening to sue if this doesn't go all single family. Hopefully, after public hearing late in May a compromise can be reached to B-3, light industrial and residential. There are many conditional uses in the area. Extension of Services: Parks, Cash in Lieu of. C. Manning has met with Fire Chief Doty and DPW Hammer regarding the possibility of a tag on annexations, getting money similar to cash in lieu of parks to sometime in the •future help support building of a satelite.fire station on the hill if city growth goes that way. Chief Doty is checking area for plans and doing research but it is hoped to try to accumulate dollars for future demand. C. Springer expressed concern about annexation exceptions, which are losing parks land and cash. He feels that the lot size should make a difference. The intent of the exception policy was for a one family type of unit, not -a specified number of acres. C.A. Neier was to review this policy brought before the Council several years ago. C. Manning will check back in Annexation Committee meeting minutes on this. The park concept needs support on any property. C. Springer wants to go on record as being concerned ever since he took office. We need a specific size limitation on exemptions; anything more in terms of square feet or acreage should be taxed. The ordinance, or state law, whichever applies, must be examined and changed, as everyone is now using the exemption. C. Manning suggested that policy be set whereby until we reach a certain population, we will not accept land, on a so many people per square acre of park land basis. MOTION: C. Manning:for the committee to recommend to Council a policy be set on not accepting land for futher annexations. Second: C. Springer. All voted aye. C. Springer asked if money in lieu of parks was an issue of the Parks or the Annexa- tion committee? In any event, the Parks Committee should be advised by FRDO in addressing this issue and it is not being done. -If the policy is adopted, part of it should be that we are immediately advised. .6 acres or less is what the exemption was supposed to be used for. FRDO will set up a meeting, including the medical community, for all involved to arrange planning. C. Palmer stated that he will attend the meeting under the condition that an agenda is prepared so that people will know what is being proposed to avoid the need for sub- sequent meetings. C. Manning stated that this was a prime area for a well designed PUD, is ideal for a mixed land use. He will pick" up on the agenda situation. General discussion of philosophy policy problems. C. Manning stated he was aware of an allusion coming from developers who are going through FRIO that the City will extend services whether annexed or not. We need guidelines as to what conditions services will be extended, and what conditions annexation -if contiguous - will occur. He feels that we should annex before extending services if contiguous; if outside and still want services, we should extend them, -but as soon as an in-between parcel requests services, they would automatically be annexed since the property would then be contiguous. Then, through waiver of right to protest the City could take in at that time. We need a writtenbasicpolicy to get away from present philosophy. C. Nystul reported on theCityof Billings procedure to extend sewer and water services outside the city. He intends to put this on the Sewer & Water meeting agenda. They are holding firm on a policy of waiving right to protest annexation before given sewer srvices. One of our philosophy problems is that in the past, because of EPA funding for the plant, we felt we had to take everyone but we are getting it clarified that the 201 facility says that if there is only one reasonable plant, everyone should use it but the Plan does not preclude us from setting procedure for that use. We need some broad framework as developers do not know what to expect. MOTION: C. Palmer moved for recommendation to Council of adoption of a policy that any obligations of offer to annex or any commitments made by the City have a time limit. Seconded by C. Springer. All voted aye. This is the beginning of a the development of a policy. C. Nystul will draft a policy regarding sewer and water, other departments can add theirs for development of a uniform policy. The FRDO will need some basic guidelines, which Mr. Verma says has never been given his office. C. Palmer suggested that a policy book be established. Meeting adjourned at 5:00 P. M. ms R 4:00 P. M. April 19, 1984 ANNEXATION COMMITTEE The Annexation Committee met on this date in the Council Chambers at City Hall. In attendance were Chairman Manning, Councilmen Palmer, Nystul and Springer, Mayor Mc- Dowell and City Surveyor Zavodny. Northwest Horizons: Chairman Manning informed the committee that the Planning Board has approved this annexation request with the following conditions: 1. That the remainder of Assessors Tracts 6D1 and 6E (described as Tract 2 - Certificate of Survey No. 7497) be annexed in addition to the requested property. 2. That new easements be provided as follows: a. 40-42.98 foot water and sewer line easements be provided along the easterly boundary of the present Tract 6E, (affects both Tracts 2 and 3 of Certificate of Survey No. 7497) and, - b. A 60 foot road, water, sewer and utility easement be provided along the south boundary of Tracts 6D1 and 6E, (affects a portion of Tract 3 of Certificate of Survey No. 7497) and would connect Bountiful Drive with Buffalo Hill Drive. 3. Prior to construction or installation of utilities, the Fire Chief approved water supply, hydrant replacement and access, and other fire protection items. The hospital agrees to the annexation, otherwise, it would create an island. The pro- perty is generally located between Kalispell Regional Hospital and City Reservoir No. 2. City Attorney Neier is checking whether we have to go through the complete process; a public hearing is set for May 7. We have a 36' easement along property line --the water line is 37' out, not within easement. A cul de sac will be needed. Discussion about _letters from various departments with their recommendations with a need for a department head sign off sheet followed. This policy should be reinstituted, as it is the only way of knowing that each involved department has addressed each re- quest. Before the Planning Board can act, Extension of Services has to be addressed to DPW Hammer. This has to be in City Clerk's office 20 days prior to public hearing. C. Manning is developing a check list system; a file will be available in the Council Chambers for Councilmen who do not attend meetings. It is their responsibility to be- come familiar with the file before public hearing, etc. - Discussion of duplication of time and expense in the annexation of this piece of property occured. It was decided that more information should be obtained at a pre - annexation meeting before the Resolution of Intent --that is the time to address problems. C. Nystul presented the following reservations: Easement may give latitude for water transmission, but he wants to be sure that no one will want a street going through. Re the cul de sac, it should be spelled out who is responsible to maintain it. Is there sufficient right of way for Sunnyview Lane. He hoped that the committee will in the future contemplate street lighting. The time for doing the project is to in- stall underground.wiring and metal poles; otherwise overhead wiring and wood poles must be used. An addendum as condition of annexation of lighting concern was decided.
