The Annexation/Water & Sewer Committees met on this date at 4:00 P.M. in the Council
Chambers at City Hall. Attending were Chairman Palmer, Mayor McDowell, Councilmen
Nystul and Ruiz, Councilmen Elect Manning and Schindler, Water Supt. Hughes, Surveyor
Zavodny, City Attorney Neier, Engineer Dean Marquardt, Water & Sewer Consultant Tom
Flynn, Dan Brien of Hersman Land Survey, Herbert Sandon and Skip Stout.
Before bringing the meeting to order, Palmer announced implementation of annexation
clipboard, listing request, date received, file number issued, name of project, date
of public hearing -if any -and completion date. This will be available to all and will
contain the minutes of the latest committee meeting. Files, of course, will corres-
pond with issued numbers.
1-83 Emma McCartney Title Problem: South Meridian Road
Marquardt summarized the history of the title problem for the area in South Meridian
Road at the corner of 7th Street West. The original plat for Ashley Township was filed
in 1891; 6 stone monuments were erected. A resurvery was done the next year and one
monument apparently was displaced and consequently the description was altered. Some
20 years ago, Lot 8 was given over to the County for taxes. Subsequently the area in
error, went to the City. Taxes and sewer charges have been paid and Marquardt re-
quests the city to issue a quitclaim deed to allow Mrs. McCartney clear title. In
October 1969 the County deeded the road right of way to the City
Zavodny recommended that the deed be granted by Council action and properly filed.
Palmer and consenting council members moved to make recommendation to the City Council
at the 11/21/83 meeting to adopt quitclaim subject to conditions.
9-83 Vacating Woodland Heights Subdivision
Daniel Brien, representing Edwin and Donald Anderson, of Anderson Masonry, stated rea-
sons for their petition for the city to vacate Woodland Heights subdivision. The land
is located in Sec. 8, T28N, R21W, PMM and is in the city limits. Parties holding title
are Edwin and Donald Anderson, Herbert and Gloria Sandon and the City of Kalispell.
Because of problems caused by an improper deed exhibit, the County is unable to file a
recently prepared mortgage survey on the property. Zavodny explained the desirability
of vacating the subdivision. Zoning, altering property descriptions were discussed
and the general concensus was for recommendation for Council approval.
10-83 Greenacres West Water Extension
Marquardt stated that services around the first of the year would be satisfactory.
Superintendent Hughes will prepare a memo regarding the extension for committee
edification by that time.
2-83 County Roadways to be Annexed to the City
A public hearing will be held on this at the December 5 Council Meeting.
11-83 State Roadways to be Annexed to the City
A Resolution of Intention will be prepared on this project.
3-83 Extension of Services Plan
Time was set for a public hearing for December 5.

4-83 Annexation of Sunset Addition #1
A plan is required before further action can be taken on this project.
5-83 Meridian Addition Zoning
City Attorney Neier suggested that the mayor sent a letter to FRDO requesting informa-
tion why certain portions of Meridian Road is not zoned; explaining that they should
be and requesting that zoning occurs. He stated that it was the intention of the
City Council to zone the entire town and this area should be zoned. This should be
considered by Council at the next meeting.
7-83 Planned Unit Development
Attending councilmen stated they had no problem with PUD and Palmer stated that a
public hearing would be set for December 19.
Miscellaneous
Hughes stated that a temporary drain field is being used at present and that the holding
tank might require an extended line. He felt that the department would be ready to
take it by July 1 and will investigate options in the meantime.
Palmer stated that a policy was needed between Annexation and Sewer and Water com-
mittees regarding extension of services and annexation. Ruiz mentioned that the
annexation policy regarding service has been changed periodically during his tenure
as councilmember.
Supt. Hughes will attempt to get information on this from the state.
