Present were Mayor McDowell, Councilmen Palmer, O'Boyle, Grainger, Ruiz,
and Saverud and City Attorney Neier.
There is a,zone change request for the Pack property on Highway #93 North
and Reserve. It is presently zoned agricultural, but it is a gravel pit
and office and not suitable for agriculture or residential. It comprises
about 50 acres. They are asking it be zoned industrial.
Councilman Saverud stated that we have stood our ground on keeping all the
area non-commercial.
Mr. Pack will not be in town for this Council meeting, so will hold it for
next meeting.
Councilman Palmer stated that there would be a public hearing tonight on
the zone change for the Downtown Redevelopment area from LI and CLI to C3
and a public hearing on zoning for the same area.
Surveyor Zavodney discussed streets and roads within the City, but which
do not belong to the City. One suggestion is to ask the County to dedicate
them to the City. The largest problem is whether or not the police can
cover.
The Annexation Committee met on Friday, July 15, 1983 at 4:30 P. M. in the
Conference Room. In attendance were Chairman Palmer, Councilmen Wayne Saverud
and Gary Nystul, and Mr.Ron Pack.
Discussed were the Pack zone change requests for land west of Kalispell on
Idaho Street. This 50 acre area is described as Lot 3, lst Addition of Pack
Addition #91 which is now zoned as agricultural and residential. His request
is for Industrial zoning with 12 acres at the corner of intersection to be
designated as Commercial. All other corners to Whitefish Stage are Commercial.
Also requested was that the area southeast of the intersection of HW #93 and
Reserve Drive be changed to Industrial and the portion of the area immediately
adjacent to the intersection of HW #93 and Reserve Drive be designated as
Commercial. Both are currently Agricultural. The City County Planning Board
has approved the change of land use request. Mr. Pack stated that he has also
been given two right of ways by the Highway Department.
Chairman Palmer stated that were was concern about individual permitted use. He
contacted Nakul Verma at FRDO to ask what goes in Industrial zoning under the
Comprehensive Plan. Mr. Verma stated use under Industrial is up to interpretation;
that Federal book -which is similar to City -would be used. He felt that Industrial
would fit Ron's use. Chairman Palmer said that PUD would address future changes.
Councilman Saverud stated that he was concerned about setting precedent but under-
stands Mr. Pack's wish to legitimize his operation.
Mr. Pack's request for change of zoning at Highway #93 and Reserve Drive has been
approved by the City County Planning Board. He has also been given two right-of-
ways by the Highway Department.
Councilman Palmer stated that the committee would report to the Council and that
a representative of the FRDO office would be at the July 18 City Council meeting
to review what uses are allowed for areas referred to.
