06-17-82 Annexation CommitteeANNEXATION COMMITTEE MEETING 4:30 P. M. JUKE 17, 1982 The Annexation Committee met at 4:30 P. M., June 17th in the Conference Room at City Hall. Committee Chairman Palmer presided. Those present were Councilmen Vidal, Saverud, O'Boyle and Ruiz; Director of Public Works Hafferman; City Attorney Neier; Building Official Shoemaker and Dr. Pearson. The first item discussed was the request from Dr. Pearson to add on to his building at 344 lst Avenue West. Building Official Shoemaker explained that we are operating under two sections of the zoning ordinance which are in conflict. One section specifies that it would be permissible and another section says in HUD development only. C®uncilman Saverud stated that the simple way to correct the situation is to include "small animal clinic" in C3 zoning. HUD will start processing a loan for the addition while the Council works on the amendment. Clerk directed to write to the Zoning Commission requesting "small animal clinic" be included in C3 zone. The Outlaw Inn Annexation set for public hearing for July 6, 1982. Walter Resubdivision set for public hearing for July 6, 1982. Hamilton Trailer Park, a resubdivision of Demarsville outside city jurisdiction. No action taken. On a request to establish Lamplighter House at 146 3rd Avenue West, the Committee will take the recommendation of Building Official Shoemaker that it be classified as a "group home" which is permissible in a D4 zone and let them proceed. Clerk instructed to write them that it is o.k. Regarding the project of annexing all city parks outside the city limits, it was suggested that the golf course be added. The last nine hole area is outside. A new petition from Forest Industries to annex and build a lumber yard on Four Mile Drive will be forthcoming. This is located across the highway from the proposed college campus. A resolution of intention to annex Treasure State Plaza will be on the agenda for the next council meeting. This is an area belonging to Dale Collins who is proposing to build a 38 unit senior housing project. Councilman O'Boyle pointed out that Mr. Collins is annexing areas without providing proper streets. We need a road right-of- way north and south from Two Mile Drive to Three Mile Drive. The Hutton Annexation (FVCC) is set for public hearing for July 19th. City Attorney Neier reported a call from Attorney Marshall Murray, attorney for the Huttons, stating that unless the college purchases the property they do not want to annex. The college will not know if they can purchase the property until after the election on September 14th. Councilman Ruiz pointed out that the college will pay no taxes, but will receive all city services such as fire and police protection as well as sewer and water. He proposed that they not annex, but form a sewer and water district and receive these services only. City Attorney Neier to contact College President, Dr. Gatzke with this proposal. Director of Public Works Hafferman stated that it would benefit the City to put a water line to this area. Adding a line at their expense would provide adequate fire protection to areas already in the City and protected by only one main. Regarding the Medical Arts Resubdivision, it is the recommendation of the Street and Alley Committee that the City require dedication of another 25' radius off each side of the street which is only a 40' street. This will make it easier for snow removal, better visibility and generally safer. The State Highway Department should be contacted before this resubdivision is approved by the Council. At the request of the police department, the public works department is working on the following roads which belong partly to the City and partly to the County to correct City boundaries: the end of 14th street; Highway #93 and 3rd Avenue; Highway #93 North; 8th Avenue West near Engel Addition; llth Street West; 7th Street West and the roads in Park View Terrace. The public hearing for the Heller Zone Change Request will be held at the next meet- ing, June 21st. Committee members indicated there may be some protests. Meeting adjourned at 6:00 P. M. ITEM 1.
