07/08/68 City Council Minutes06 A regular meeting of the Kalispell City Council was held July 3, 1968, at 7:30 P.M. in the Council Chamber7.. _favor Bjorneby presided. Councilman Happ was excused fror., the meeting. All other councilmen were present. The minutes of the meeting bci ld iuly 1, 1968, were read. Councilman Roberts moved approval of the minutes as read. Seconded by Courciirran .lensley and carried. ;fear and Fass on Protests - �necial Lighting District �k53 (�idams addition): A written protest was received from Donald Pasha L Lorene H. Pasha, 209 Hawthorne Street. Their obiectiorr was the additional tax burden the lighting assessment -.could 11e to them. Following cons ideratior <)F the protest, Councilman Riley moved adop- tion of Resolution Co. 2696 - A Resolution Creating Special Lighting Dis- trict #53 (Adams Addition). Seconded by Councilman liiron. Roll call vote. All voted aye. Open Bids.- S.I.D. 305 Bonds- No bids were received. Councilman Henslev moved Yalror F.jor.neby he euthorized to negotiate the sale of bonds. The bonds are tcn ,e scald at not less than par, plus ac- crued interest and the interest r to not to exceed 6;!. Seconded by Coun- cilman Roche and carried. Addressing the Council: Councilman Hensley presented r17,7 following letter from '3ert Orr: Kalispell City Courcil Kalispell, Montana Council Members: Because of a previous corrmitr,cent, I am unable to attend your meet- ing, therefore please accept 1-1-.is note as a request for your con- sideration of my application for a city>, license to carry on the popcorn concession at the spoil previously occupied. Due to the favorable response th�:t I have received from townspeople and businesses alike (14 of the r*:ajor businesses signed a petition so stating) I am convinced that there is not the type of objections that warrant closin- down the business. To impose this restriction raft,: the accompanying financial loss, is I believe unjust, therefore I request your careful consideration of this matter. Thank you kindly, (Signed) Bert Orr 826 - 6th Ave. West The City Attorney was consulted as to the legality of the issuance of a license for this purpose. City :',ttorney Donahue read Section 24-10 of the Code of the City of Kalispell entitled "Vending on Streets." No action was taken. Committee Reports: Safetv - National Safety Council Survey: Councilman 11iron reported the Safety Committee and the Mayor met with the Chief of Police and repre- sentatives from the National Safety Council. The Committee has recommended this City's participation in the Safetv Council Survey. Safety - Councilman Miron reported Fire Chief Tillson has requested the confirmation of Bernard Hanson as Fire Captain as he has completed satisfactorily the probation period. Councilman Miron moved Bernard Hanson be confirmed Fire Captain. Seconded by Councilman McCormick and carried. Safety - Councilman Miron reported Police Chief Waggener requests the confirmation of Bill Bagenstos as Police Patrolman. The probationary period has been satisfactorily completed. Councilman Aiiron moved con- firmation of Bill Bagenstos as Police Patrolman. Seconded by Councilman Hensley and carried. Safety - Supervision of Parking Meter Department: Councilman Aiiron reported some question seems to exist as to who has jurisdiction over the parking meter man. The committee recommends the Parking Meter Department be placed under the jurisdiction of the Police Chief. Councilman Roche moved the Parking Dieter Department be placed under the jurisdiction of the Chief of Police. Seconded by Councilman Hensley and carried. Fire Marshall Gene Thompson reported on the Fire Mlarshall's activi- ties during the month of June. Ass't. Fire Chief Peterson reported on the Fire Chief's Convention in Billings, which he attended. Employment - Wage Meeting: Councilman McCormick reports:(' +-he committee met with personnel of the Clerk and Water Department offices. The requests for wage increases is to be considered at budget time. Councilman AcCormick moved acceptance of the committee report. Seconded by Councilman Miron and carried. Finance - Councilman Hensley reported the Finance Committee has audited all claims for the month of June and approved them for payment. Councilman Hensley moved acception of the Finance Committee Report. Seconded by Coun- cilman. McCormick. Carried. Parks - Vandalism at the Swimming Pool: Councilman 11,oche reported that there has been some minor vandalism at the swimming pool and requested an off -duty policeman be hired to police during the evening for a short period to bring about an early control to the vandalism. Liquor & Beer Applications: Off -Premise Beer Buttrey Foods x Rosauer's x Safeway Stores, Inc. x Councilman O'Brien moved approval of the above Freer license Applica- tions. Seconded by Councilman Aiiron and carried. Correspondence: A letter was received from W. E. Hutton & Company srnti,nc they were interested in bidding on the $43,000.00 bond issue. In a letter from City Engineer McClintick, he recommended approval of the work done by Falls Construction and approval of the payment of $5,000.00 withheld. Lease of Metered Parking Lots - The proposed lease of Valley Bank and Conrad National Bank lots was discussed. The matter will be given further consideration at the July 18th meeting. Miscellaneous: Councilman Roberts reported a trailer located at California and 1st Ave. E.N. is in violation of City Ordinances. Police Chief_ Waggener re- ported that this trailer is to be removed within the next few days. Councilman Roberts reported there have been complaints crn.cerning car -hops at drive -inns with long hair and not wearing hair ne`s. The City Sanitarian reported that some hair sprays were bein,- allowed in place of hair nets. The Sanitarian is to check on the complaints. Councilman Hensley moved for adjournment. Seconded by Councilman Riley and carried.
