A Special Meeting of the Kalispell City Council was held November 18,

CITY OF KALISPELL, MONTANA
Gentlemen:
There will be a Special Meeting of the City Council Tuesday, November
18, 1969, in the Water Office at 5:00 P.M. for the following purpose:
TO CONSIDER: DON MC CLARTY PROPERTY
We, the undersigned, being all of the members of the City Council, do
hereby waive notice of the date and purpose of the Special Meeting of the
City Council to be held Tuesday, November 18, 1969, at 5:00 P.M., and con-
sent to the transaction of the above and any other business that may properly
come before the Council.

Mayor Bjorneby presided at the meeting. All councilmen were present.
Councilman Miron reported he had contacted Mr. McClarty. Mr. McClarty
has agreed to deed the point of land in question to the City provided the
City pays one-half the cost of the retaining wall located on his property,
exclusive of that portion of the retaining wall put in by the City.
Councilman Roberts reported the committee met and suggested the City
deal with Mr. McClarty in the amount of $800.00 for the point of land. The
$800.00 represents one-half the cost of extending the retaining wall.
Councilman Roberts contacted Mr. McClarty since meeting with the -committee
and he has agreed to deal for the sum of $700.00. The committee recommends
the City pay Mr. McClarty the $700.00 for the point of land even though it
is generally felt by committee members that the City has previously com-
pleted its obligation. Councilman Roberts stated that he felt this was the
cheapest way out.
Councilman Miron moved the City offer Mr. McClarty $700.00 for a quit
claim deed for the triangle of property for street right-of-way. Seconded
by Councilman Riley.
Councilmen Miron, Roche, O'Brien, Riley and Roberts voted ave. Coun-
cilmen Hensley, Turner and McCormick voted no. Motion carried.
Mayor Bjorneby indicated he might exercise the veto, but that he would
contact Mr. McClarty prior to a decision on a veto.
The meeting was adjourned by Mayor Bjorneby.
