During budget sessions this year, discussion was held in regards to information from the City in respect to the airport referendum that will be on the ballot in November. Information that is provided by the municipality should adhere to state law regarding the use of public personnel, or funds related to ballot issues. Adopting a statement of record is valuable in that it identifies the information related to the ballot issue impact in respect to the operations of local government. State Statute 2-2-121 MCA addresses this area as follows: (3) (a) Except as provided in subsection (3)(b), a public officer or public employee may not use public time, facilities, equipment, supplies, personnel, or funds to solicit support for or opposition to any political committee, the nomination or election of any person to public office, or the passage of a ballot issue unless the use is: (b) As used in this subsection (3), "properly incidental to another activity required or authorized by law" does not include any activities related to solicitation of support for or opposition to the nomination or election of a person to public office or political committees organized to support or oppose a candidate or candidates for public office. With respect to ballot issues, properly incidental activities are restricted to: (i) the activities of a public officer, the public officer's staff, or legislative staff related to determining the impact of passage or failure of a ballot issue on state or local government operations; In identifying the impact of passage or failure of this ballot issue, the Statement of Record is presented in a fashion that adheres to this requirement. FISCAL IWACT: There is no fiscal impact to the adoption of a statement of record for a ballot issue. RECOMN ENDATION: It is recommended that the City Council adopt the Statement of Record related to determining the impact of passage or failure of the airport referendum ballot issue. City of Kalispell Statement of Record In July of 2012, the City Council voted 5-4 in support of Resolution No. 5572. This resolution accepted the Kalispell City Airport Master Plan update submitted by Stelling Engineers, Inc., on April 4, 2012, and approved the plan alternative to develop the airport in collaboration with the Federal Aviation Administration as described in Chapter 6 of the subject Master Plan update as Site I, Option B: Existing Site with ARC B-H Standards. To achieve this, the primary development of the alternative would be to lengthen and relocate the runway further to the south. The runway would be lengthened from 3600 feet to 4200 feet and improved to meet FAA design standards. As part of this development, additional activities would need to be performed, including land acquisitions, which are outlined in the Master Plan found at http:l/www.kalispell.corn/ai!port/master plan u dates. h . In September of 2012, the Flathead County Election Administrator concluded that enough signatures had been submitted to place a referendum to repeal Resolution No. 5572 on the election ballot. In November, this referendum will appear on the City of Kalispell ballot. Voting FOR this referendum would repeal the resolution. Voting AGAINST this referendum would affirm the decision made by the Kalispell City Council in passing Resolution No. 5572. Voting FOR the referendum If the resolution is repealed in the November election, the City of Kalispell would not pursue the future development of the city airport as described in the resolution. A vote repealing the referendum does not restrict the operation of the airport in its current configuration. Voting AGAINST the referendum If the resolution is affirmed, the City of Kalispell would pursue the development of the city airport as described in the Master Plan and seek the assistance of Federal funding. Financial impact related to developing the airport according to the resolution passed by the City of Kalispell The proposed development and funding plan is set forth in the Master Plan, Chapter 7, found at www.kalispell.comlaimort/master„plan., updates.php.
