THE REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:30 P. M., MONDAY,
APRIL 17, 1978 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR RAPP PRESIDED. ALL COUNCIL-
MEN WERE PRESENT.
APPROVE MINUTES
Councilman Daley moved that the minutes of the regular meeting of April 3, 1978 be
approved as presented. Seconded by Councilman Allen. Motion carried.
Councilman O'Boyle moved that the minutes of the special meeting of April 12, 1978 be
M approved as presented. Seconded by Councilman Saverud. Motion carried.

Councilman Allen moved the bid be referred to the Street & Alley Committee with power
to act. Seconded by Councilman Williams. Motion carried.
PETITION - SID for Park View Terrace
RESOLUTION #3168
Councilman Griffin moved to adopt Resolution #3168 a resolution of intent to create a
Special Improvement District for Lots 33 through 44 and that portion of Harrison
Boulevard adjoining said lots of Park View Terrace Addition #1 also known as Annexation
#85, in the amount of $50,000 for the design and construction of all necessary water
' lines, sanitary sewer systems, storm sewer lines, roads, curbs and gutters on said
property in accordance with City specifications. Seconded by Councilman Allen. Roll
call vote. All voted aye.
Stan Pine, developer of the above property, addressed the council concerning the amount
of money due the City in lieu of park land. Council directed him to meet with City
Attorney Donahue and the annexation committee to set the value and appraisal to determine
amount due park fund in lieu of park land.

The above list includes Medicare/Medicaid patients. The balance due is considered
uncollectible It is not legal to bill the patient for the balance after Medicare and
Medicaid have made payment on the account.

Fire Chief Peters stated that in a conversation with Bill Smithers, agent for Montana
Physicians Service who handles Medicare, he was told that July 1st they will be paying
a minimum of $44.00 on each ambulance run. Minimum is $28.00 at this time which lacks
a lot in paying a $60.00 ambulance run.
On request of Councilman Allen that Street Foreman Clements and William Maurer travel
to Minneapolis to pick up the new oil distributor at a savings of $375.00, Councilman
Williams moved that a claim for $500.00 for travel expense be allowed. Seconded by
Councilman Allen. Motion carried.
Councilman Williams reported that the budget report for three —fourths of the year is
running about.72.1% which is good. If an emergency budget is necessary for any depart—
ment, the hearing can be set the last of May.
ANNEXATION
Councilman Griffin reported that the annexation committee met and discussed the request
of Gary McClarty to move a house to a location which does not meet the one house —one
lot requirement. The committee recommended that the decision be made by the Board of
Adjustment.

Councilman Allen moved that curbs
be ordered in for 1978
as follows:
Upright concrete curb both sides of 1st Avenue West between 9th Street
and 13th Street West, Kalispell Original
Concrete curb and gutter both sides of 7th Avenue West between 2nd
Street and 6th Street West, Addition #1
Concrete curb and gutter both sides on 3rd Street West between 6th
Avenue and 7th Avenue West, Addition #1
Concrete curb and gutter both sides of 4th Avenue West between West
Center and 2nd Street West, Kalispell Original
Seconded by Councilman Williams. Motion carried.
ORDINANCE #890
Councilman Allen moved enactment of Ordinance #890 an ordinance amending the 'no park—
ing' ordinance to include an area on east side of Hwy #93 from Hwy #2 to West Washington.
Seconded by Councilman Daley. Roll call vote. All voted aye.
Councilman Allen reported that the On —Going Traffic Committee discussed the traffic
hazard at the intersection at Underpass Hill and Woodland Heights. There has been a
total of 33 accidents since 1973. State engineers are not sure a traffic light is the
right answer. Councilman Allen asked the council safety committee to pursue the
problem.
Councilman Allen reported that the contract for installing the traffic light at.11th
and South Main has been let to Harp Line Constructors.
GOLF COURSE LEASE
Councilman Daley moved that the council authorize Mayor Happ to sign a one year lease
with the Kalispell Golf Association for the lease of the golf course and approve a
10% raise in fees. The Park Committee, City Attorney Donahue and Larry Simpson,

Golf Association President have prepared the lease.
Motion carried.
Seconded by Councilman Allen.
SAFETY
At the request of Police Chief McDowell, Councilman O'Boyle moved that the police
department be allowed to purchase two more radar guns at the price of $723.00 per
unit. This will make it possible to install one in each police car. Seconded by
Councilman Grainger. Motion carried.
HEALTH
Councilman Saverud reported that the City -County Health Board met last Tuesday. One
of the chief concerns is the amount of rubbish in the barrow pits from Kalispell and
Whitefish to the land fill. The City of Kalispell has an ordinance which states
garbage -may only be hauled in covered vehicles. Councilman Saverud asked the news
media to publicize the fact that violators will be ticketed.

Councilman Saverud moved that Mayor Happ be authorized to proceed with obtaining a
HUD grant for the Kalispell Redevelopment Association, an organization interested in
renovating the Kalispell business districts. Seconded by Councilman Williams. Motion
carried.
SEWER & WATER
Councilman Granmo reported that the request for a water rate increase will be heard by
the Public Service Commission at 10 A. M., April 18th in the council chambers.
INSURANCE
Councilman Grainger reported that there are questions on our liability insurance premium
which has been studied by the insurance committee. He is awaiting the arrival of new
Finance Director Williams for assistance on our insurance program. There is also the
question of when does the City take over responsibility for fire and liability insurance
on the new city hall under construction.
MISCELLANEOUS '
Councilman Allen reported that work is starting on the new city shop. The gas tanks
will be installed this week.
Mayor Happ said that getting members for the Citizens Advisory Committee for the 201
Study is very slow. She has one member, Mark Metzger. She felt the study needs more
publicity to explain what is going on and this may attract more members.
Director of Finance Williams was supposed to begin work on April 17th, but was ill and
has not started as yet.
The Tri-City meeting will be held Wednesday Noon, April 19th at the Outlaw Inn.
There will be a special meeting at 5 P. M., April 27th in the council chambers to open
bids on the new police cars.
Councilman Daley moved that Mayor Happ be authorized to attend the League of Cities
Board Meeting in Helena on April 27th - funds for travel to be paid from city council
budget. Seconded by Councilman Allen. Motion carried.
City Attorney Donahue reported that he wrote to the Statewide Committee that is working
on a new system for holding elections whereby counties would conduct all elections. He
has the first draft of the plan in his office and invited any interested persons to .
stop in and read the proposal.
Mayor Happ read the following letter from the Kalispell Public Schools:

Mayor Happ reported that she wrote to each utility company, all engineering firms
and all contractors, and asked them to inform Fire Chief Peters when they plan to
move any of their utilities, or do any construction work. The fire department needs
to know when a street is going to be blocked.
Councilman Williams announced his intention of being absent from the City from April
28th through May 6th. Councilman Saverud will be in charge of approving claims
during his absence.
Councilman Granmo announced his intention of being absent from the City from April
27th through May 2nd.
Councilman Williams moved to adjourn.
