01/09/78 City Council Minutes269 THE REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:30 P. M., MONDAY, JANUARY 9, 1978 IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR HAPP PRESIDED. COUNCILMAN WILLIAMS WAS ABSENT BECAUSE OF ILLNESS; COUNCILMAN DALEY ON VACATION; COUNCILMAN GRANMO ATTENDING A REFUSE DISPOSAL DISTRICT MEETING. ALL OTHER COUNCILMEN WERE PRESENT. ADDRESSING THE COUNCIL Darrell Clothier, 744 6th Ave. West addressed the council concerning the animal ordinance. His dog was picked up and he was fined in addition to kennel charges and license fees. He stated that almost any criminal is given a warning and second chance, but a dog owner is fined on the first offense. He stated that it was unjust. Mayor Happ told him that the fine is up to the Judge and not a thing the council can decide. Dan Nelson, representing Citizens Against Pornography, informed the council that the group will be circulating a questionaire on community standards on obscenity throughout Flathead County. It has been designed to collect community opinions on the availability of pornography in Flathead Valley. They want comments from the councils of the 3 cities as to its usefulness in preparing ordinances within the cities which will reflect the wishes of the city's residents. The form has been approved by the County Commissioners. AWARD BID - New City Shop Councilman Allen moved that the bid for the new city shop be awarded to the low bidder, Dyck Construction Company for the building and electric wiring. Seconded by Councilman O'Boyle. Councilman Griffin voted no. Motion carried. AUTHORIZE BIDS FOR CHLORINE Councilman Saverud moved to authorize advertisement for bids for chlorine for this year. Seconded by Councilman O'Boyle. Motion carried. COMMITTEE REPORTS ANUS) ATION Councilman Griffin reported that several annexation petitions and proposals are in the mill and his committee will be meeting to consider each of them. STREET & A= Councilman Allen reported that his committee is considering making Mission Drive a one- way street because of the traffic hazard where it intersects with Highway #93. A request from the Kalispell News Agency for a curb out at 1131 S. Main will be studied by the street and alley committee and reported at the next meeting. SAFETY Councilman O'Boyle had no report. HEALTH AND SANITATION Councilman Saverud had no report. FINANCE Councilman Grainger reported that the finance committee met to review claims for January, found them in order and moved that they be paid. Seconded by Councilman Allen. Motion carried. ORDINANCE #111 Councilman Grainger moved enactment of Ordinance #886 an ordinance amending the rates for building moving. Seconded by Councilman Allen. Roll call vote. All voted aye. EMPLOYMENT Councilman Grainger peported that there are three proposals for group health insurance which he and the special insurance committee will review. A letter concerning the $1,000.00 bond required of electrical contractors was referred to the finance committee and given to Councilman Grainger. SEWER & WATER Councilman Allen moved that a request for a sinter shut -down for the EDA Storm Sewer I 070 Project be granted, effective December 3, 1977. Seconded by Councilman O'Boyle. Motion carried. Councilman Grainger reported that the City has not as yet received a permit for the new water well. Problems have arisen from protestors and the number of days they have to protest after being notified. BID FOR WATER WELL Councilman Allen moved that the Water Well Improvements bid be referred to the sewer and water committee with power to act. Seconded by Councilman Grainger. Motion carried. Doug Daniels, Thomas, Dean & Hoskins, Engineers, reported that a public hearing on the , 3rd Avenue E. N. Storm Drain System will be held late in February or early March. Director of Public Works Knebel reported that construction on the aeriation basin at the wastewater treatment plant is progressing, but very slowly because of weather conditions. Mayor Happ appointed the following to the Parking Commission: Henry Good and Francis Bitney, 4 year terms; Mary Rooney, 3 year term; Lee Bishop, 2 year term; Lorraine Bundrock, 1 year term. Because of a scheduled public hearing by the Board of Adjustment on January 16th, the regular council meeting will be postponed until January 23rd. POLICE RETIREMENT FUND Councilman Grainger moved that Mayor Rapp be authorized to sign an agreement with P.E.R.D. to fund a $394,000.00 deficit in the police retirement fund at the rate of $33,000.00 for the next 20 years. This will be raised by a mill levy over the 65 mill limit as provided by state legislature. Seconded by Councilman O'Boyle. Motion carried. The Tri-City meeting will be held at noon, January 18th in Columbia Falls at the Meadow Lake Country Club. Councilman Allen moved that Mayor Happ be permitted to attend a board meeting of the League of Cities & Towns in Billings on January 2Oth with per diem and mileage allowed. Seconded by Councilman O'Boyle. Motion carried.
