The Special Meeting of the City Council was held October 18, 1977 in the
council chambers of City Hall at 7:30 P. M. Mayor Happ presided. All
councilmen present.
City Attorney Donahue advised that Judge Smith of the Federal District Court
in Missoula had issued a restraining order late this afternoon. This prohibits ,
the City from opening the bids on the EDA Storm Sewer Project. The action is
brought by the Montana Contmactors Association and Lockrem Construction of
Billings. The basis of the suit is that the 10°% Minority Business Enterprise
requirement of the EDA grant is discriminatory. Copies of the complaint and
restraining order have not yet been received.
Mayor Happ asked if any contractor wished to withdraw their bid. No one
responded.
Bids have been received from: Clark Brothers Construction; Pack and Company;
Trails End Construction; and Lyford Plumbing. The bids have been sealed and
placed in the vault.
Mayor Happ introduced new councilman From Ward II, Wayne Saverud.
Meeting adjourned at 7:45.
