Donaue jk, e ty Attorney Mayor Happ presided, All councilmen were present. 18G Mayor Rapp briefly explained recently passed legislation changing the amount cities may charge for alcoholic beverage licenses effective July 1, 1977 and further explained that this would reestablish the amount that can be charged for these licenses to what was the established charge prior to the 1973 legislative action. ORDINANCE NO. 874 — Alcoholic Beverage Ordinance — Councilman Granmo moved to enact Ordinance No. 874 establishing the City charge for Alcoholic Beverage Licenses and Beer and Wine Licenses to the maximum permitted by State Statute. Seconded by Councilman Williams. Discussion concerned the loss of revenue to the cities by action of the 1973 legis— lature. 1977 legislation would restore same. Question called. Roll call vote. All voted aye. INTENT OP INSPECTOR TO RETIRE — Mayor Happ reported receipt of letter of intent to retire from Building Inspector Jackson and requested council authorization to advertise to fill the position. Councilman Williams moved that Mayor Happ be granted permission to advertise for person to fill the inspector job. Seconded by Councilman Allen. Motion carried. OLD DUMP SITE Mayor Rapp reported a request to lease the old dump site. The old dump site is located on Willow Glen Drive. Possible sale of the property was suggested. Councilmen were instructed to look at the property and consider request at a later meeting. ADDITION #83 Attorney Ken O'Brien representing Bob Monk regarding the Resubdivision of Lots 7, 8, 9, Block 1, Poston Addition — Addition #83 asked the Mayor and Council to act to accept this resubdivision as they would like to close their transaction Thursday. The closing was dependent upon the approval of the resubdivision. City Attorney Donahue reported there has been a recent Supreme Court decision where the resubdivision requirements have been changed but that he had not received a copy of the decision to review. Therefore, he could not determine for the council the effect of this decision on this resubdivision. RESOLUTION NO. 3114 Councilman Grainger moved adoption of Resolution No. 3114 a resolution to approve as a subdivision of the City of Kalispell, the resubdivision of Lots 7, 8, and 9 in Block 1, Poston -Addition — Addition #83 and providing for the waiver of park require— ments. Seconded by Councilman Griffin. Discussion followed regarding acting too hastily on this resubdivision. The matter has been presented to the City only a short time ago and should have been presented earlier to warrant action at this time. Park requirements should be required.
