10/09/72 City Council Minutes335 THE REGULAR FETING OF THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, WAS HELD IN THE COUNCIL CHAMBERS OF CITY HALL AT 7:30 P. M. OCTOBER 9, 1972. MAYOR BJORNEBY PRESIDED. ALL COUNCILJ%IEN WERE PRESENT. The minutes of the regular council meeting of October 2, 1972 were read. Counc11- man Miron moved approval of the minutes as read. Seconded by Councilmen Schwerts. Carried. CITY OFFICIAL REPORTS City Clerk - City Treasurer for August City Engineer - Police Judge - Police Chief - Sanitarian for September Fire Chief for 3rd quarter Councilmen Thomas moved acceptance of the city official reports, provided letter of resignation of sanitarian withdrawn. Seconded by Councilmen Miron. Mayor BJorneby reported Sanitarian Goulet had withdrawn his resignation. Question called. Motion carried. ADDRESSING THE COUNCIL Mr. Larry Thomas, representing the Parking Commission, briefly reviewed for the council the Phase I and Phase II goals of the perking commission and reported to the council the parking commission is negotiating a lease with First Federal Savings & Loan for lots located between lot and 2nd Stests West and facing 2nd Avenue West which would be space for the parking of 48 autos. Mr. Thomas presented Mayor and Councilmen with copies of drawing of the layout of the proposed parking lots. Mr. Thomas reported that It would cost in excess of $10,000.00 to improve the lots for parking. The lots would be umaetered and the spaces would be leased to businesses for employee parking at $8.00 per space per month. Mr. Thomas reported that the lease payments would be $250.00 per month and taxes would be about $50.00 per month. The lease would be for a sewn year period. Councilmen Inquired if it might be better for the Parking Commission to purchase the property. Mr. Merritt Warden, legal counsel for the Parking Commission, reported to the Mayor and Council that the Parking Commission we a separate corporation completely separate from the city and was of the opinion that the perking commission was not authorized by statute to purchase property. City Attorney Donahue informed the council that he was of the opinion that the statutes did authorise the parking commission to purchase property. Councilmen Thomas reported he felt the parking commission should proceed on a more grandiose scale that the present proposal would not meet present meads, let slope future needs. Councilmen Miron reported that he supported the parking commission proposal. Mr. Larry Thomas reported that this was a start that he felt the parking commission would be able to gain momentum and be able to close the gap on meeting the needs of the city for off street parking. RESOLUTION NO. 2879 Councilman Schwartz moved adoption of Resolution No. 2819 A Resolution appropriating funds for the parking commission and requiring quarterly reports to the city council. Seconded by Councilmen Miron. Roll Call vote. Councilman Slater voted no. All ether councilmen voted aye. Resolution No. 2879 adopted. From our past experience with the last unit this firm sold to the city.the factory was very slow upon delivery as to their quoted time. They will not give us a definite time on delivery and we certainly could not live with a $50.00 a aay penalty, or keep up the maintainence and repairs on the present vehicles. Carried. 344 COMMITTEE REPORTS - City -County Planning Board - Councilman Daley reported on the meeting regarding the Bitney-Bruyer property development - 380 acres divided into 5 parcels. They have applied for sever clearance on 35 acres of the development which would involve about 19 homes. Most could use septic tanks for a short period. Councilmen Daley said an environmental report on the area had been submitted by Will Aiken of the State health Department outlining methods of sewage disposal suitable for the area. Mr. Stew Petrint, Area Kanner, is to draw up another impact statement regarding the Bitney-Bruyer development to be acted on at a meeting tomorrow. Councilman Mixon reported the city is concerned about this development and the manner to which the sewage is treated because of the possibility of contamination of the Stillwater River and the City of Kalispell water supply. Councilmen Mixon further reported that he felt that city services should be limit- ed to the city but that the APO wants the city to extend its water and sever service outside the city. City Engineer McClintick reported that it may be necessary for the city to extend Its services in order to receive federal funds - that the sewer service may end up as a metropolitan sewer district. AREA PLANNING ORGANIZATION - Councilmen Schwartz reported the APO was outling its duties for the following fiscal year such sat Area Wide Subdivision Regulations Mobil Nome Regulations Bass Map of Area Land Use Study Central Business District Land Capability Study Subdivision Activity Map Safety - Councilman Thomas reported that the fire department has used up the amount budgeted for overtime, and request an emergency budget of $4,000.00. Councilman Thomas moved adoption of Resolution declaring that an emergency exists and that it is necessary to make expenditures in excess of the amount provided by the 1972-1973 budget for overtime for firs department expense. Seconded by Councilman Mixon. Councilman Sister asked if the council could authartse the transfer of the expanse to other budget items of the fire department. Councilman Miron withdrew second. Councilman Thomas withdrew motion. RESOLUTION NO. 2880 Councilman Thomas moved adoption of Resolution No. 2880 Authorising the Fire Chief to charge overtime expense to other budgeted items of the fire department budget. Seconded by Councilman Sampson. Roll Call Vote. All voted aye. Parks - Councilman OOBrten reported the School Board has authorised lease for the tennis courts and that they would not use the courts for auto parking if this proved to be damaging to the teemis courts. City Attorney Donahue is drafting the lease agreement. Finance - Councilman Sitter reported the committee has audited claims for the mouth of September and recommend@ payment. Slater moved adoption of the finance committee report. Seconded by Councilman O+Brien. Carried. Street & Alley - Councilman Hopp reported that the State Highway Department would look up the 345 traffic lights to the emergency system of the fire department, except from the corner (by the fire department) to the control panel in the fire department - a cost to the city of approximately $300.00. MISCELLAHWUS BUSINESS - City Engineer MoClintick reported that the State Highway Deparboant is striping Main Street and it will be necessary to remove parking meters - 3 at Mouses - 1 at Conrad Bank - 4 at each intersection; paint curbs yellow - to most highway regulations. City Eaginser McClintick recommended the extension of the storm sewer from 8th Street to Center Street on lot Avenue treat. This would take load off the sanitary sewer system. Gas tax money could be used for this project and City Engineer MaClintick recommended the council set this as a first priority for the use of the gas tax funds. City Clark Beardsles reported that the Board of Trustees of the Police Pension Fund raeammeeded.$30,000.00 of Police Pension Fund Cash be invested in 3 month Time Certificates of Deposit and that at the 3 month maturity, approximately $20.000.00 (or the amount of sidewalk and curb warrants available) be invested In sidewalk and curb warrants of the City of Kalispell, and recommend the City Council direct the City Treasurer to male these In astmenta. Councilman OtBrion moved the City Treasurer be directed to invest the Police Pension Ponds as recommended by the Board of Trusts" of the Police Pension Fled. Seconded by Councilman Kapp. Carried. Mayor Sjornaby presented an assoment, Block ", Lots 17 & 18 to Pacific Power & Light Company. Councilman Miron moved approval of the granting of an easement to Pacifto Power & Light;Company. (Portion of property located immediately north of and adjoining the north boundary line of Lot 18 of Block ") Seconded by Councilman Thomas. Carried. City Attorney Donahue requested permission to attend a Planning & Zoning session in Dallas, Tome, November 1 - 3 and that transportation, per diem and $50.00 membership fee for Municipal Legal Standards Center be authorized. (registration fee leas to members) Councilman Delay moved City Attorney Donahue be authorized to attend the Dallas mooting with transportation, per dies, and membership fee authorised. Seconded by Councilman Thames. Carried. Mayor Bjonwby brought to the attention of the council the need for the city to reapportion the voting wards. Councilman Miron moved adjournment.
