Meridian Road MEETING DATE: September 3, 2013 BACKGROUND: The Kalispell City Planning Board met on August 13, 2013, and held a public hearing to consider a request from Cooke Thompson to change the zoning from R-4 (residential) to B-1 (neighborhood business) on two lots located at 1252 N. Meridian Road. The lots, also known as Lots 18 & 19 of Northwest Tracts Block 1, are on the west side of the road, halfway between Three Mile Drive and U.S. Highway 93, in the Southeast '/ of Section 1, Township 28 North, Range 22 West, P.M.M., Flathead County, Montana. They cover 1.8 acres. This area of North Meridian Road buffers residential neighborhoods and Kalispell Middle School from U.S. Highway 93. The existing R-4 zoning allows for primarily single-family and duplex residential dwellings, while the requested B-1 zoning provides for "certain commercial and professional office uses where such uses are compatible with the adjacent residential areas." Planning Department staff provided the planning board with a brief presentation of the proposed zone change. During the presentation, staff highlighted the Kalispell Growth Policy, which identifies the area as an "Urban Mixed Use" zone, which is consistent with the B-1 (neighborhood business) zoning. The B-1 zoning district permits a range of residential and commercial uses, but does not allow industrial and agricultural uses. The surrounding properties are currently zoned for commercial uses, with many of the lots already developed for commercial use. Following the staff presentation Board Member Richard Griffin stated he is employed by one of the adjoining property owners that have been notified of the proposed zone change. He asked the board members if they had any concerns regarding his involvement in this decision and discussion. If they did, he would recuse himself from the discussion. City Council Member Guiffrida asked if he had any fiscal involvement. Griffin said no, and therefore the board felt he could participate. A motion was made and seconded to adopt staff report KZC-13-01 as findings of fact and recommend to the Kalispell City Council that the two properties be rezoned from R-4 (Residential) to B-1 (Neighborhood Business). The motion was unanimously approved. RECOMMENDATION: A motion to approve the requested zone change for the two properties located at 1252 N. Meridian Road from R-4 (residential) to B-1 (neighborhood business) as recommended by the planning board. FISCAL EFFECTS: Approval of the request would have minimal fiscal effect to the City. ALTERNATIVES: Deny the request. A public hearing has been scheduled before the Kalispell City Planning Board for August 13, 2013 beginning at 6:00 PM, to consider the zone change request. The planning board will forward a recommendation to the Kalispell City Council for consideration. BACKGROUND INFORMATION The planning department received a zone change request from Cooke Thompson, the owner of two lots located at 1252 N. Meridian Road, also known as Lots 18 &' 19 of Northwest Tracts Block 1. The undeveloped lots are situated on the west side of N. Meridian Road approximately halfway between Three Mile Drive to the south and U.S. Highway 93 to the north. The neighborhood area currently serves as a transitional -buffer zone between U.S. Highway 93 to the east and the middle school and residential neighborhoods to the west. It also serves as an alternate transportation connection between the southwest side of town and Highway 93 North. The Northwest Tracts subdivision was originally platted in 1947. The plat created parcels out of the eastern half of the southeast quarter of section 1, presumably for residential development. Since that time, the majority of the subdivision has undergone numerous lot combinations and subdivisions, and seen a steady pattern of residential development. The exception has been the small group of parcels in the immediate vicinity and the two parcels under this request. As recently as 2006, the two parcels were being used as a mobile home park together with a single-family residence. That use has been discontinued and the property has been cleared of all improvements and stands ready for development. The land uses in the vicinity of the subject property are a mixture of commercial and residential, with the commercial uses predominating. The property to the immediate south is owned and operated by CenturyLink Communications as a service center and maintenance yard. To the west, there are two undeveloped parcels within the Northwest Tract subdivision. These parcels gain access from Northwest Lane, the primary access to Kalispell Middle School. To the northwest is the Sinopah residential subdivision, containing 18 single-family residences served by Northwest Lane. To the immediate north, there are four residential properties containing 1950's era homes. Across N. Meridian Road to the east, there are several automotive services and various health care services. To the southeast, also across N. Meridian Road, is the UPS office and shipping center. Meridian Road. Factors for consideration include encouraging low - intensity rieighbQrhood businesse-s in this transitional area while seeking consistency between the zoning designations and the growth policy land use maps. Location and Legal Description of P peM- The two lots included in the zone change request are legally described as lots 18 and 19 of Block 1 of Northwest Tracts. The lots are located in the Southeast 1A of Section 1, Township 28 North, Range 22 West, P.M.M., Flathead County, Montana. C. Existing Land Use and Zoning: As stated above, the two paroels under request for zone change are currently 1_mdeveloped, and are currently zoned R-4, Residential. The intent of the R-4 zoning district, per Kalispell Municipal Cade (KM ) 27,07.010, is that of primarily single-family and duplex dwellings in areas designated as urban residential on the Kalispell Growth Policy Future Land Use Map, D. Proposed Zoning: The proposed zoning district for the subject properties is B-1, Neighborhood Business, The intent of the B-1 zoning district is, "To provide certain commercial and professional office uses where such uses are compatible with the adjacent residential areas. This district would typically serve 2 as a buffer between residential areas and other commercial districts" (KMC 27.12.010) The prospective owner has expressed the intention to develop a family dental clinic on the subject properties. D. Size: The two lots cover a total area of approximately 1.8 acres. The dimensions are 200 feet of frontage on N. Meridian Road, with a depth of 405.6 feet to the west. E. Adjacent Land Uses and Zoning: North: Residential, R-3 East: General Business, B-2 South: Public, P-1 West: Residential, R-3 F. General Land Use Character: The general land use character of this area can be described as a mixed use commercial/residential area. Commercial uses predominate along N. Meridian Road, while the major land use to the west is Kalispell Middle School and surrounding single-family residential properties. G. Utilities and Public Services: All three properties are served by city water and sewer and by city streets. Public Comment: Prior to submitting the zone change application the planning department discussed potential issues with changing the zoning on just the lot owned by Ms. Thompson, the applicant for this zone change. No other comments were received from the public as of the writing of this report. ZONE CHANGE TO B-1 BASED ON STATUTORY CRITERIA The statutory basis for reviewing a change in zoning is set forth by 76-2-303, M.C.A. findings of fact for the zone change request are discussed relative to the itemized criteria described by 76-2-304, M.C.A. and Section 27.29.020, Kalispell Zoning Ordinance. Does the requested zone comply with the growth policy? The property is designated by the Kalispell Growth Policy future land use map as "Urban Mixed Use" which calls for a compatible mix of higher -intensity uses including office as well as some commercial and light industrial; medium and high density residential and public facilities. The proposed B-1 zoning designation permits a range of residential and commercial (both retail and service uses), but no industrial or agricultural uses. Chapter 4, Land Use: Business and Industry, in the Kalispell Growth Policy document includes the following goal: GOAL 7: MAINTAIN THE INTEGRITY OF WELL -ESTABLISHED RESIDENTIAL AREAS BY AVOIDING ENCROACHMENT OF INCOMPATIBLE USES. The request to change the zoning to B-1 will permit the development of the two lots into a low -intensity commercial use that fulfills this area's role as a transitional zone that protects the character of the residential areas to the west from the impacts of the Highway 93 corridor to the east. The property could develop with a professional/medical office that would provide a service to the local community. 2. Will the requested zone have an effect on motorized and nonmotorized transportation systems? The properties requesting the zone change to B-1 will not produce a noticeable impact to motorized or non -motorized transportation systems. The properties are served by N. Meridian Road, an arterial roadway, with one lane in each direction, a center turn lane, sidewalks on both sides of the road and bike lanes. There is adequate capacity on N. Meridian Road and the associated intersections to accommodate anticipated development on the subject properties. 3. Will the requested zone secure safety from fire, panic, and other dangers? Adequate access and public facilities are available to the properties in the case of an emergency. There are no features related to the properties which would compromise the safety of the public. All municipal services including police and fire protection, water and sewer service are available to the area. 4. Will the requested zone promote the public health, safety and general welfare? The requested zoning classification will promote the health and general welfare by restricting land uses to those that would be compatible with the adjoining properties and those in the vicinity. 5. Will the requested zone provide for adequate light and air? Setback, height, and lot coverage standards for new development or redevelopment occurring on the two lots are established in the Kalispell Zoning Ordinance to insure adequate light and air is provided. 6. Will the requested zone facilitate the adequate provision of transportation, water, sewerage, schools, parks, and other public requirements? All public services and facilities are currently available. Development should be encouraged in areas where these services are available. L! 7. Does the requested zone give consideration to the particular suitability of the property for particular uses? The requested zone change brings the two properties into conformance with the planned growth policy designation for the area and matches the zoning of properties across the street. Furthermore, the uses that will be allowed under the zone change on the properties are compatible with the other commercial uses along N. Meridian Road. 8. Does the requested zone give reasonable consideration to the character of the district? The general character of the area is that of an urban mixed use area. The requested zoning allows for a range of residential and commercial uses on the property, but limits those uses so that there would be little or no impact on the nearby residential neighborhoods in the R-3 zone. 9. Will the proposed zone conserve the value of buildings? As stated above, the property is currently undeveloped. The development of the property with an urban mixed use development would likely increase the value of commercial buildings in the area as it evolves into a mixed -use transitional area. 10. Will the requested zone encourage the most appropriate use of the land throughout the municipality? Mixed use urban development should be encouraged in areas where services and facilities are available. The proposed zoning is consistent with the growth policy future land use designation and the growth policy's goal of providing a mix of commercial and residential uses in appropriate locations.
